Please help, J1 waiver, NIW, EAD

Hi,

This forum has been very helpful for J1 waivers. Thanks for all.


My wife is a physician, working on J1 waiver and we applied for NIW.

Today I (spouse) received my Employment Authorization Document (EAD).


My question :

I wanted to attend the school to get the Masters degree.

(1) Can I attend the school FULL TIME with EAD ?

(2) Can I work for some time and then go back to school or

If I start working with EAD do I need to work continuously?

With EAD, you are free to work or not work as you wish.

Can I ask when the application for EAD was made?

You are as free as a bird thanks to your wife's petition. Provided she continues to fulfill the terms of her NIW petition(and expect to get one or two RFEs asking that she is progressing toward the 5yr stipulated period) and all else is well, both of you could chose to be in a "pending485" status. This is a valid, legal status and entitles you to derivative benefits such as EAD for work, AP for travel out of the USA. As for what you do with your time as a "dependent485" of her, there are very few restrictions on that as far as I know. Student, part time work, full time work, even a business if you can stomach the risk is legit.
