Please help !! I-131 ADVANCED PAROLE ...TRAVEL DOCUMENT

Well to start off GREAT SITE!! Lots of info here!

My wife is from Bulgaria and we live near Tampa Florida, we file the 485 a little over 2 years ago. In March we filed for the I-131 AP with the Tampa office, then somehow I guess it went to Missouri, but ever odder the return envelope said it came from Chicago.....well anyway back to the main reason of this post...

We bought plane tickets a few months back to make our trip to Bulgaria ....problem is , we have these plane tickets set for us to leave May 29th ...at this time she doesn’t have permission to reenter the USA .. We don’t want to lose the $2000.00 we played for these plane tickets...

As of yesterday we went to the local office showing them our plane tickets and so on ...they pretty much told us to give up and go home...



Can you please help me with this matter? We really need some help and not sure what to do ...wife is very upset... she wants to see her family and we have been planning this trip for 6 months.

I dont know if your case is employement based or family based.

If I-485 is filed you need AP approved in hand in US before you go out of US to reenter US with AP.

Local office can only approve AP if you have AP filing reciepts AND you have some EMERGENCY and you prove with evidence for the Emergency. Bying fligh ticket is NOT emergency, everybody will buy the ticket and go to local USCIS for AP do you mean they will approve AP? No, they dont do that.
 
Thanks for the reply ... define = EMERGENCY, but what do they call an emergency? What type of proof do they need? I read they need a translated doctor’s letter? Where would you get a doctors letter translated? Does this involve the Embassy?

Generally if some close relative is admitted in hospital then you can get fax from doctor or hospital, many USCIS local office have provided the AP based on the emergency evidence and I know 2-3 cases in NJ and MD area they were Not given AP even after they submitted to emergency documents/hospital fax/ doctors fax. It all depends on USCIS officer if he is kind hearted he approves the AP

------ Doctor can send the letter or fax written in English, most of the doctors know the English, he must write the reason and that you must visit to see your parent/relative and why your presence is needed

OH another question ,, if there is a emergency ..would you need to go to the local office and ask them for AP ? Im asking cause the local office isnt working on out case, , they sent it to mussouri cause they were backed up and needed help "i guess"
 
SO your saying MSC is in Chicago ..but Chicago doesnt even process the I-131's ......thats what im confused about . Im going to enclose a picture of out recipt from the office , maybe this will help decide what direction i need to go from here .

As you can see at the bottum , thats where the INS agent in Tampa told us to write ,, BUT thats in MISSOURI !! .....so if we write to that office it wont get to the right people cause the case is actually in Chicago .
