PLEASE HELP! ( i-130,i485,i912 :)

First of all thanks for taking a minute to read my post. All replies are greatly appreciated as I have a few questions and concerns regarding my immigration case.

1. My then 4yr/o son and I came to the U.S through the Buffalo/Ontario Border to visit my bf in Sept 2011. I was never stamped, just waved through. I was only planning on staying for a few weeks. 2 years later we have a 1yr old child together and are just recently married. I believe I am an over stayer - will this present a problem when filing i-130 and i-485?

2. Most importantly what has held us back from filing anything to get my residency here was the fact that we've been under great financial stress - My husbands work went on strike for a good portion of the year, we lost our apartment and lived in a hotel for a while and he is also on L&I due to work related injury. We basically live pay check to pay check and we definitely do not have the large lump some of cash to pay i-130 and i-485 filing fees! My question is under what circumstances will a fee waiver be approved for i-130 and i-485? Would our situation qualify? I am afraid of it being denied, not being able to afford filing fees and then deported and sent away from my family :(

a) Do i file TWO i-912 (fee waivers) for both i-130 and i-485 separately? or just one for both packages?

3. Lastly, can we just file for myself first to get the greencard and work authorization and THEN file for my 6yr old son? Or do i HAVE TO file his with mine? We definitely cant afford TWO filing fees! Until i can work atleast!
