I am currently on a H1 visa. I will finish with company A on Feb 2 2005. I have 797 approval and h1 visa till Feb 2007. However, since I will be out of status on Feb 2nd, I am applying to change to H4 as my wife's dependent. My new job with a University officially starts on March 1st. So I will be applying for a H1B premium processing around the 3rd week of february. I want to go to India for a month in March after my H1B is approved and start my job in April. My employer is OK with it.
Is there any problem with having a H1 approved and not starting until a month later. Is there a time frame within which I should start?
