PLEASE HELP!!! GOT RFE!! Don't know what to do!

SoDesperate

Registered Users (C)
Hello, I'll try to be brief:

Originally entered the country in 1998 on F1 visa.
Had valid I-20 until February 2002
NEVER GRADUATED COLLEGE. (Was doing acting programs with no degree)
Got a job a filed a Labour Certificate. It was approved.
My I-140 and I-485 both were denied because "Employer's Tax Returns do not show ability to pay beneficiary" (I was FURIOUS because I was obviously being paid.)
Sept. 2005, married my long-time boyfriend and in Oct. 2005 filed I-485 under the Cuban Adjustment Act.
Have had 2 EAD and 2 AP. Name check pending for 4 years! (Since my previous 485 petition I suppose)
FINALLY April 24, 2008 I was Fingerprinted for the second time! I thought the end was near!
But yesterday I received an RFE (although it doesn't say RFE) from my local USCIS office saying that in order to continue processing my application, they need me to send in my CERTIFIED COLLEGE TRANSCRIPTS and MY ORIGINAL I-20.
Why do they need this for a marriage petition???? It will be VERY hard for me to get any kind of transcripts as the schools that I went to didn't really hand out "grades". Is this a bad sign? Or is it just an officer justifying their pay-check???
I'm freaking out! This has been the most frustrating, heart-breaking thing I've ever been through.
Please let me know if you guys think it's normal to get a request like this for a marriage petition! And if this is a good sign (that my case is being viewed) or a bad sign (they're nit-picking).
I'm so desperate to get this ordeal over with........

FYI no LUD on uscis.gov even though I received the RFE.

They can ask for whatever the feel they need. Perhaps they want to verify you entered the country legally. Perhaps they want to verify that you did not use an F-1 visa to enter the country with no plans to ever attend an academic institute.

Ok calm down for a bit.. they might be asking for that because they may want to verify ur status prior to ur marriage ... and how u entered the country .. so dont panic..

Thanks guys...
I know I'm a bit agitated but I'm must so terribly frustrated with the whole situation.
In my panic I never realized that they probably just wanted to verify how I actually entered and if I studied. Thankfully I kept every I-20 I was issued so I can prove I went to school. Also, I talked to my schools in New York and they're going to try to put together some type of "transcript" for me. They won't be what the I.O. is expecting to see (because of the 'no grades') situation, but at least it'll prove enrollment.

Once they recieve my response to their RFE, is there a chance they'll issue another one? Or basically they would have asked for everything they needed in this one?

Do you guys think I'm close to being Greened?????????

USCIS can ask anything they want but it NOT necessarily that you would dance to their tunes. Provide what you have and if you don't have anything then simply give them reasons. If they deny your application then the COURT door is open to fight back. Don't lose your sleep on it...

Remember to make copies of what you are sending, keep a copy of the RFE letter with you for your records and use certified mail to send the RFE with the evidence needed back.

Good luck.

Thank you Ok-Boy...I will try to calm down. You're right, whatever I can't get I will simply explain in my cover letter to the I.O. I find it incredible that they are holding up my green card for this when it's un-related! (People who have been here illegally for years get their GC when they marry a US Citizen (or LPR), and someone like me who's always been legal, who has always paid taxes, is given the run-around.) I think these officers need to justify their paychecks and that's why the hassle us.
Hopefully next week I can send-off the reply to the RFE and this will finally be the last thing they need from me before approving my GC.
