Please help EB 1

Hello I am a physician from India

I have a few publications around 40 with 15-16 first authored (12-15 are case reports)

The problem is that none of them are in a big journal like impact factor more than 3

More of my publications are on Optics and developing and designing lenses to view the eye during surgery... though this is helpful and people use them hardly anyone writes about them so my citations on those papers are just 2-3

I have other citations on some ideas of instruments and surgical techniques which have another around 10 citations so a total of 12-15 citations

I have reviewed over 15 papers for 7-8 journals
I have an honor award from an American Society
I am members of 2 societies who need some publications like Sigma
I believe i can get 6-7 letters

Should this fly for an EB-1

Should I use a lawyer ?
I am really concerned and stressed as i am nearing my H1 completion and may not have a job in time

It certainly sounds like the kind of stuff they are looking for. But EB-1s are never a sure shot deal, if they go through they are great, but I wouldn't bank on it alone.

Lets see, you managed to amass this publication record. Sounds like you are able to read and write. You probably could do it yourself. There are a couple of kits out there with sample letters and sample petitions. While it would be absolutely idiotic to just copy these documents (every year there are a couple of morons who do this, they get a standard denial telling them which kit they copied from), you can use them as a guidance to see what they are looking for.

Writing an EB-1 petition is nothing you should have to do under pressure. It takes a while to get the various letters, also you want to be able to revise your petition about 25 times until it really showcases your achievements to the goverment official.

It is by the way not about the length of the petition. If you have the achievements to fulfill EB-1 or OR, a couple of pages will do. (my attorney somehow met one of the adjudicators doing EB-1s and NIWs. he told him that he only reads the first 6 pages of these petitions before he makes up his mind whether he approves it or not. anecdotal evidence granted, but it makes sense considering the severe time constraints these guys have to adjudicate petitions.)


Are you an ophthalmologist ? If you are, your optics and lense record will help you for an EB-1. You'll have to fashion it in a way that you are planning to stay in academics and forward the science.
