please help, desperate

Firstly apologies if this is filed under the wrong post, I am new to this forum and this is my first time writing anything on here. I am a Uk citizen who came to the U.S on a four day stay to meet a woman who I had an online relationship with for several years, we wanted to see if there was any kind of romance and as it turned out there was and we made our way straight to Reno. I flew back to the UK within a day or two of being married and made plans to come back to visit in Feb 2002, due to work commitments I would only be staying a month. I arrived on a visa waiver and my with fell pregnant within a month of my arrival, sadly she miscarried and out of concern for her well being i overstayed my visa, she became pregnant again and gave birth to our daughter the following year. My wife also has a son from a previous marriage who has cerebal palsy, I began caring for him and as he got older and bigger, I took over full time care. It has now been almost 11 years since I originally arrived here, I have not worked but have cared for our son and home schooled both him and our daughter who is a US citizen. I have never commited any crimes, got into any trouble with the law...nothing. I am just tired of living in fear of being deported, I really would like to find out if I will be deported and banned for 10 years and if so how this process works. I can't imagine the harship on my wife if I leave, our son with palsy is 18 this year and needs help being lifted from his bed into a chair etc. My wife is unable to do this and would not be able to cope.

Again any help/replies would be greatly appreciated
 
Talk to a lawyer. The overstay might trigger a 10 yrs ban. I doubt hardship will work, as the mother of the child is here in the U.S and you are not the legal guardian (I assume). Good luck.

the ban will trigger only on leaving, so make sure u do not leave till u have ur green card.

other than that, overstay is forgiven for spousal green cards. just file i130 and i485 with all supporting forms and documents.

Leaving with Advance Parole should be okay, no?
