Hello every one,

My wife who is a Canadian Landed Immigrant (Indian Citizen) got her H1 approval few days ago. She has been with me in US on the TD visa as I am under TN NAFTA Visa for the past 2 years.

She only got a i797 and at the end of the i797, the portion where you can tear off, it says the following :

"The alien may use this portion when applying for a Visa at an American consulate abroad, or if no visa is required, when applying to admission to the US"

And also has bunch of her personal info, So is this the i94 form ? because she did not get any other forms other then is i797 and I cant find the word i94 any where on this form.

Does she has to get her pass port stamped before she starts working ? and if we were to go to Canada to get the pass port stamped, does it have to be done at the US consulate or at the Air Port ? And lastly does Canadian landed immigrants have to get an appointment with the visa office do this.

Thanks a million for all the help.

After calling the 900 number many times I have been told that even if my wife is a Canadian landed immigrant from a common wealth country, she still needs an appointment to get a visa stamped. The funny thing is if you try to use the web site to book an appointment it will not allow you to book it saying she is a landed immigrant, but when you call the 900 number they insists on it saying that is a new policy.

Any way, now my wife has a i797, can she start work as she is already in the US or does she has to go out and get a H1 stamped before she starts work. She never got a i94 with the i797, but her old i94 is valid for another 8 months.

Thanks

Jay
