Please Help - Canadian Geting Married To Us.

Hi, the reason i am writing is because i am a Canadian and i am getting married to a US Army citizen and we have two kids.. now what would be the best way to get it so i can live in the US cause he can not move to Canada as he is in the Army .. and we do not know when he will be deployed and he wants the kids and me to be covered .. ?? what do you do i have tried contacting the Immigration place but still havent heard nothing from them
 
Are you inside or outside the US? If inside, legally or illegally? If legally, what is your status? Have you secured US passports for the children?

Your answers will affect how to proceed.
 
inside the US and its during my 6 months, its very long and confusing to explain the whole story.. i just need to know should we get married then apply for me to live in the US or what cause with him being Army we never know when he might deploy or what..

My experience is when things are long and confusing, it's that much more important to get the whole story.

If you wish to stay in the US, yes. What is the status of the children?
 
I don't want to hijack the thread here, but instead of creating another one, I'll post my story as it's somewhat similar (just in terms of citizenship).

I am a Canadian citizen, and I entered the US (legally) two weeks ago. My girlfriend has a GC, but should be receiving her US citizenship in a few months (her N-400 was originally processed in late January).

I simply want to know what the best strategy is for us to stay together (in the US), and for me to be able to obtain a work permit. So, my first question is, should we wait until she receives her citizenship before getting married? Second, I assume the best course of action is to get married in the US during my stay (I have at least 5 more months that I'm legally allowed to be here) and before we file any paperwork. My final question would be, if we get married and then file the paperwork, and my 6 months visitor visa expires, am I now residing illegally in the country? Or, am I simply a legal resident waiting on official status?

Basically, I've been reading a lot about the CR-1 and K1 visa, but since I'm already here, I'd rather not leave the country and then have to wait 9 months to come back.

Your situation is different enough that you should start your own thread -- you don't have children, your fiancee isn't already a citizen nor in the military, and there are more yet-to-be-revealed facts that will likely further distinguish this thread from your case.
 
Okay so Story.. Both Children are the US Military Citizen how ever one was born in Canada, i had come to the US to visit him, and was planing on going back to Canada because he was in Texas for Training .. how ever was not able to go back to Canada at the time due to was not able to travel so had the baby in the US.. he comes home in May and we are getting married.. but what i am so confused about is that i keep being told that i have to go back to Canada for 5 months and wait for forms, then i hear its better to get married then apply because he is army it may be faster, but i do not understand any of it because he wants me to live here with him as he can not move to Canada with being in the Army.. am i able to stay in the US get married then apply for green card forms or no.. cause we are not sure when he may deploy :( .. i hope this helps abit more and really hope someone can help.. because i am so very scared of something bad happening or going wrong because we are not trying to commit fraud or anything like that and i just want everything to work out and be legal

Does the one born in Canada have a US passport, or a Certificate of Birth Abroad issued by a US consulate? If not, there may be other challenges and expenses.

What is "w.e"?

If you get married first, you can stay in the US and file the green card forms and interview in the US. Otherwise, if you're going to delay the marriage, he can file I-129F for the fiancee (K1) visa, and then you would interview for it a few months later at a US consulate in Canada. Then after entering the US with the K1 visa, you have 90 days to get married and then file the remaining paperwork.
