I have an I-140 approved in EB3 category (PD May 99). Same company has applied for EB2 I-140 for a more senior position for which I-140 is pending. The LC for EB2 was applied in Dec 2000 and approved. I-140 is in VSC with a RD of Feb 2001.
Now that EB3 dates are current, if I apply with my EB3 I-140, will this cause a problem ? Can I amend my I-485 to the EB2 category once the I-140 currently pending is approved ? Will that be an issue ? If I remember right, I saw a posting by BJSR saying this is possible.
Could you please give me some details ?
