Hello, I am currently getting ready to file for green card and I have a few last questions I hope someone can help me with. First off, a little background. I am a Canadian citizen living and working in the US(Indiana) for the last 5.5 years on a TN visa renewed yearly. Lastest TN will expire Aug 24, 2007. I got married to a USC on December 8, 2006.

1. For filing form I-864, we plan to submit copies of last 3 yrs tax forms filed to IRS. Do we need IRS-issued transcript or are these copies sufficient?
2. What constitutes proof of current employment?
3. I am confused as to whether or not I need to submit form I-131. Is this necessary if I would like to travel out of US while forms are processing? Should I not travel outside of US while the application is pending?
4. Is it alright to send all forms together in a bundle to the USCIS Nebraska Service Center? Should I provide a cover page stating all enclosed documents?

Any other advice would be appreciated. We have decided to file the forms ourselves as an immigration lawyer would add alot to the already expensive forms.

Thanks!

2. What constitutes proof of current employment?
a letter from your current employer, current paystubs

3. I am confused as to whether or not I need to submit form I-131. Is this necessary if I would like to travel out of US while forms are processing?
yes, it is necessary. Did you read the instructions to form I-485?

Should I not travel outside of US while the application is pending?
that depends on whether you have ever been illegally present in the US

4. Is it alright to send all forms together in a bundle to the USCIS Nebraska Service Center?
no. The bundle needs to go to Chicago lockbox. Did you read the instructions to form I-485?

Should I provide a cover page stating all enclosed documents?
it is useful, although not required.

Yes, I have read these forms many times. I am confused, that is why I am posting the questions. Does anyone have any useful answers?

Am I wasting $170 by applying for the I-131 unnecessarily?

You need to submit copies of 1040s, W-2s and any 1099s (e.g. interest income). If you don't have these, you'll need to get the transcripts.
2. What constitutes proof of current employment?
Copies of recent paystubs, letter of employment.
3. I am confused as to whether or not I need to submit form I-131. Is this necessary if I would like to travel out of US while forms are processing? Should I not travel outside of US while the application is pending?
It is necessary if you wish to travel while AOS is pending, yes. You can no longer travel on your TN visa once you submit AOS. If you leave the USA without AP while your AOS is pending, USCIS will consider that you have abandoned your application.
4. Is it alright to send all forms together in a bundle to the USCIS Nebraska Service Center? Should I provide a cover page stating all enclosed documents?
As Lucy says CHICAGO LOCKBOX not the Nebraska Service Center. The address is on the front of the I-485. A cover page is mainly useful for you, but is not required by USCIS.

Thanks for your responses.

Can you please elaborate on what should be included in the letter of employment? Any samples?

On headed notepaper:

To who it may concern,

This is to verify that Mr. Smith is employed by our firm as a Grade III dog groomer on an annual salary for $40,000 per year.

Sincerely,

Mrs Smith
Secretary
