PLease help again AKMR or some one else. MArriage and I 485 question

CAse: My friend already applied I-485 last year(Not approved as of yet). FP scheduled. He wants to go to India to get married and bring his would-be spouse along with.

If his spouse comes here in US on H-4 and in the meantime his I-485 gets approved (say when they just landed in US) , can his spouse still go ahead and apply for I -485 on his priority date. If No what is her status etc.

Delay FP

One option is to delay FP. Bring your would be, file all the papers for her and do FP.
To delay FP get it rescheduled telling you would be out of country or just do not do
FP on that day. In the later case you can do FP at some centers like San Jose even though
your schedule date of FP has passed.

Get other opinions as well and try the best one.

Postpone FP by scheduling with the INS.

Hi,

As Ricky said it might be a good idea to reschedule FP with the INS and go to India in the interregnum. Come back to the US with the wife on H4 and file for her I-485. The FP can be done as per the schedule so that INS does not consider the case abandoned.
