Please help...Advance Parole question

Hi!

Just got my I140 approved so please bear with me. I have tried to read up the archives but still have questions.

Assuming that my lawyer files my 485,EAD,AP on Sept 15th this year
when can I expect to get my Advance Parole based on recent trends?

I have non-refundable tickets to Egypt (2 x $$$$) and must travel no later than Dec or I will forfeit the money. Is it at all likely that I can get AP before December?

Thanks in advance for any insight. Also, please point me to relavant sites where I can read up.

AP may not be needed

Hi,

If you use your EAD then when you travel you need
to use your AP to re-enter.

If you have no need to use the EAD (for example
if you have a number of years left on your H1)
then I would advice that you continue on your H1.
(Please note that I am not a lawyer and this is
to the best of my knowledge)

If you remain on your H1 then all you need on your
return is the I-485 receipt which seems to take anywhere
from 3 to 8 weeks.

Thanks

I just got my H1 on Jan 20 this year so I have a long time left.

I am told that I MUST have my 485 receipt in hand before I leave the US. If you don\'t have the receipt, then the officer at the port of entry could tell you that you have abondoned your immigration petion by leaving the country even though you have a valid H1. Apparently this is very subjective i.e. depends on how anal the officer is.

Thanks for the info.

No Title

It is taking app. two months to get receipts. So if you file for 485 now you will get your receipts app. in November first week. AP may take app. a month after that but as per your postings you don\'t need AP to travel.
