Hi,

Could someone give me some advices?

My mother is a U.S citizen. She filed I-130 on April, 2004 for me and I am list in the first priority (unmarried son over 21 years old of U.S. citizen). I am currently living in Taiwan, not U.S. territory and wait for the approve of the petition.

My question is,

1. If I am married in Taiwan, should I file the adjust of priority from 1 to 3 (married son of U.S. citizen) ? Will it affect to my waiting time?
2. Due to the waiting time is shorter for the first priority list than the third one, is there any way I can keep the same waiting time even adjust the priority from 1 to 3?

Please kindly help,
Thanks,
Wenkai

married while GC in process

If your parents are GC holders and you get married, you automatically get disqualified. If they are US citizens, it does not matter. When you file for I485, just state that you are now married.

what if the applicant is overseas?

Thanks.

But if the applicant is in overseas, there will be no 485 stage.

When is the proper time to get married and get the green card for
spouse as well? Is it better to wait until I-130 get approved and then
get married and report to national visa center at that time?

Once the cases has been transfer to overseas consulate, is there still a
chance for people to put their spouse name on the immigration visa application form?
