Please help: 1040?? 1040A?? 1040NR??

i've been working in the states for 3 yrs w/ H and a year w/ EAD. Now, which tax form do i need to file, 1040, 1040A, or 1040NR ?? i have been filed 1040NR till last yr but i heard i can file 1040 (or 1040A) although i dont have a GC yet.

Please gimme the correct answer.

Besides, is there any advantage if we file 1040(or 1040A) instead of 1040NR ??? (e.g., more refund??)

(PS) sorry for posting a non-immig issue...

If you spend more than 183 days in the US you can file as a full-year resident, and take advantage of much higher deductions on the 1040.

You may also want to investigate back-filing in previous years using a 1040-X to claim resident status.

You should have filed 1040, 1040A or 1040EZ whichever applies to you. You cannot file 1040NR if you were resident in US for more than 6 months. It has nothing to do with GC, you are considered a resident for tax purposes if you reside in US > 6months in a year. Looks like you filed incorrectly so far.

FILE AMENDED RETURNS IMMEDIATELY OR ELSE THIS COULD CAUSE PROBLEMS FOR GC.

There is no tax advantage in filing any of the 1040 forms. Some are easier to fill and you need to qualify for those forms. 1040 can be filed by anyone.

READ THE INSTRUCTIONS FOR ALL FORMS.
 
Hire a cpa and explain the situation ASAP.
I am pretty sure he/she will ask you to file 1040.
In 2000, first I filed 1040NR then changed back to 1040 according to that cpa's suggestion. I had an income around 60-70 per annum with non-working spouse that time. How much did I save-it's really big: close to 5000$! How much that cpa charged me- only 125$!!
