My lawyer sent my and my wife\'s I-485 (along with EAD and AP) application today (i.e. Nov 20 2001). I complete 6 years of H1 on Dec 31 2001. My I-94 card on the latest H1 is upto oct 2002. My wife\'s I-94 is upto Dec 2001.
Can I apply for an H1 visa even if my I-140 is approved (I thought it should be \'pending\' to get a 7th year extension)?I cannot apply for 7th year extension on basis of I-485 because I do not have any receipt of the fact that I have applied for I-485.Am I safe with just the I-485 application??? What if the mail gets delayed or lost??
