Please guide me - Married to USC Best option

Hi everyone,

I hope I am on the right forum. I recently got engaged and planning to get married soon in my home country India. My partner is a US citizen. I have a work permit in Canada now and presently working in calgary.

Please guide me on the best option to come to the US. Honestly I am confused about the options. And futher more I understand that an interview can take place either in India or Canada. Also I could come to the US as a visitor if needed.

Any input will be appreciated.

There are 2 ways you can go about this.

a) Get married in India and then your spouse applies for your I-130 which can take upto 6 months to get approved. Once that is approved, you get the visa to travel to US and then can apply for Green card here. However till the I-130 is approved you cant come to US.

b) The othe option is that your spouse applies for your Fiancee visa (I-129F) right now. That gets approved much faster. As soon as that gets approved you can come to US and have to get married in US in 90 days..

You can still have your religious ceremony in India but you will have to Show the marriage in US to apply for I130 and I-485 for GC together...

Do both these options allow me to work?

Does the quick option B have an interview before I get the visa to enter US as a fiance, if there is an interview can it be held in Canada, and do both the partners have to be present?

with K-1 visa, the interview can be held in Canada and your fiance does not have to be present. However, you have to have proof of meeting each other at least once in the last two years. Check out K-1 subforum.
