Hi,

I need advice from somebody. I have posted my case online. my case is in INS chicago, I don't know how long to wait for an interview. Now the problem is my H1 6-years will be expired on Oct 03. I am applying EAD card on June, It hasn't been approved yet. Now I am thinking of filing 1 year H1 extension just for safety. Does anybody have the experience? Do I have to do that? what kind of form do I need to file? I want to do it by myself, because my lawyer will charge me $1300 attorney fee, I already pay more than $10, 000 for all my 2 H1Bs, My 485 etc. Please give me some advice:

1. Do I have file H1 extension?
2. what kind of form I have to fill?
3. How my employer can help me?

How come you pay for H1 visa by yourself? You mentioned that you pay 10,000 to get your two visas, which I think very expensive and I think the company should pay you that money back. Aren't you working for the company that benefits from your experience and expertise? I never heard anything like this and it is not fare for you to pay for your h1b process when your company is getting most of the benefit by hiring you.

Any how I use the do it your self kit which is provided by the link below. I help my company not to pay for lawyer (Liar) about 1000 US just to fill out such a simple form. The kit might cost you around 50 US and it is very helpful and completed with the necessary cover letters and sample forms.

Thanks for your advice. I think you misunderstood what I said. I meant I pay my lawyer totally for all the application: including 2 H1 visa, EAD, I485 more than $10, 000. That is why I want to file the form by myself. If I ask my lawyer to help, he will charge me again for $1000.

My I485 has been pending for 2 1/2 years. My ND is Mar 7. You can see my post on "Transfer to local"

He is just trying to help you...
You should not be paying anything from your pocket, your employer should be doing that

Why dont you use EAD once you get it?
What your ND for EAD, it shud be processed in 15-30 days. Can you wait? NSC is taking about 2 months to approve H1B, with premium processing, its 15 days.
Now you have to weigh between time and money, indeed time is money !!

My I485 ND is Mar 7, 2001. I have H1B always, so my old EAD expired on May 2002, I didn't apply new one since then. Now my H1B will expired on Oct 2003, that is why I have to applied new EAD on June 17, 2003. I didn't hear anything from INS. So, I just wonder if I have to apply 1year extersion H1 just in case.

I know I don't have to pay any filing fee to INS, my employer should do it. But my lawyer charges me $1100 just for attorney fee. So, I want to file by myself to save money.

On Sept 18th, you can go to local INS and get iEAD. and use that to work. You'll be out of H1B Status then.

Why do you think of applying for H1 ?!!!
Since you have filed for EAD extension and you are expecting your 485 within an year --- that should be enough.

EAD extension takes about 2 months time. I applied it on May21 and got it July30. So you should be fine by the time your H1 expires. In case you do not get your EAD by that time, just stop by local INS and get iEAD. ...
 
Applied for EAD/AP (originals) Jun23 wife appr July25 I got approved Aug 1. All four AP (two small kids) approved Aug 1. Got my EAD card today, wife got hers July 31.

I think you'll get it very soon, no need to worry about october.
