Hello all,
my company is opening another branch and they are transfering me over there. They have added East to the Comapnie\'s name. My current companie\'s name is cash software and they are opening another one under Cash software East in the same state. The ID number for the original company will stay the same but they are going to get a new ID number for a new company. My job is to work for two companies but the problem is that I will get all my pay checks under the new company. I have alrady filed I-485 in December 99. How will this change affect my application? However my employer told me in case of RFE they will give me a letter from the original company which i filed for I-485. but how about my W2-form Tax? It will show my new companies name!!! DO you think that INS will ask me to file I-140 again. Any one with the same experience. PLease help. i am so worried. My lawyer is on vacation until end of September. I really appriciate any comments.

Hi, the reason that nobody has responded to your inquiry is probably because no one can really be sure of what to do under your situation. Let me just give you my opinion but take it with a gran of salt. Since you\'ll be moved physically to your new position, I\'d also look into the possibility of problem with your labor certification. The LC is restricted to a metropolitan area, so if you lived in LA and then move to SF, you will need to get a new LC. But if this is just a temporary thing, then you\'re probably okay. As far as the name of your company, if you get a Request for Further Evidence from INS, then it\'s a possibility that you may be asked to redo your I-140. But you may end up not having to, it\'s up to how your lawyer handles it and the INS officer handling your case. If you never get a RFE or never get your case transferred to local INS office (where you\'d be required to be interviewed), then you don\'t have to worry about it. While I was waiting for my I-140, my company was acquired by another company. I was lucky that INS never asked for RFE or interview. My case was approved last week (I\'ve already posted the details).

This is just my opinion, please consult with your lawyer and maybe another one to be certain. By the way, what the heck is your lawyer doing out of the office for over a month and a half? Didn\'t he/she make sure there\'s someone else to answer your question?

i work in Washington DC and New office is Maryland. Does that mean that i have to do my LC again!!! I am still with the same compony and i will work for two offices. The only bad thing is my pay check is with the new company. I think that might create a problem. I got RFE during my I-140. My lawyer is so hopless. He never helped me any way. He is the companies Lawyer and i have to work with him. Please let me know what you think? thanks again for your concern.

Hve you considered talking to your company and asking them to keep your paycheck and papers with the original company. This may be the best option you have. Just an idea....

they will give me an employment letter form the original company in case of RFE but the pay check has to be with the new company. i argued with them and they did not accept that i should get paid from the old company. its a real pain. i hope i dont have to do LC again.

Here are some things to consider:

1. is there anyway that you can avoid going to this new company? Maybe if you explain the situation to your management they will be understanding.

2. if you absolutely have to go, see if you can make it so that once your I-485 is approved, you will move back to the old office. Remember, technically the GC is for a FUTURE JOB. So as long as you go back to the exact job in the same location when your GC is approved, you can argue that it is okay.

3. Like the other person said: maybe you can continue to receive paycheck from the same company even though you\'ll be moving to another one. What is the relationship between the two companies? Do they share the same CEO or president?

4. Having a lousy lawyer can really hurt your case if things get tough. It\'s good that you are seeking info from other sources other than your lawyer. NEVER EVER EVER trust a lawyer. After my ordeal I\'ve finally realize why people hate them so much. Don\'t be shy about asking questions to your lawyer. Whenever possible, make your inquiries via email so that there\'s a record of it. If your lawyer ignores you, send followup email requesting attention and CC it to your human resource department (or your corporate immigration dept if you have one). Make sure the CC is visible to the reader of the email. I\'ve seen this method work for a couple of my friends who had lousy lawyers who didn\'t return calls. They don\'t give a shit about you, but they give a shit if they lose a big client (your company).

5. I\'m not a lawyer, but from the sound of it, a move from DC to somewhere in MD is very very likely to require a new LC. I moved ~20 miles from one small city to another within the same area of the State and my lawyer said it would require a new LC (I didn\'t tell them that I actually moved; I asked it as a hypothetical question).

Listen, I know it\'s very scary. While I was waiting for my GC not only did my company get acquired, the place I worked in was shutdown. I ended up moving to another facility (that my lawyer claimed to need a new LC) to a different job (same job title) within the company. I knew I\'d probably be screwed if I get RFE. But I was approved without it. Maybe God\'s grace was shining on me. My point is that do what you can by finding out all the info and make the best decision you can under the circumstances. If it doesn\'t work out you always have Canada where educated and hard-working immigrants are welcomed.

I am sure i could get my GC last year if i had a good and caring lawyer. THe management are the same in our company. We just have expanded the company. I guess i have to wait until i hear from Ins. This board is very helpful and i never got any good info from a lawyer. I wish i could convince my manager that i have to get paid by the original company. Oh well i guess i dont have a choice until i hear from INS. I still have not got my FP yet. Thanks again guys. PLease share your info with me if you know another person in the same situation.

is the case is same in case you got your EAD and then your company moved from one state to another state
