Please evaluate my qualification for EB1-OR

Hi, I am planing for my green card process. Now I am working in a top 10 university as a research associate. I got my PhD in China in EE. I published more than 30 papers, all in first author(5 International Journal, 2 international conference, others are in Chinese journals). But I only got 4 citations for the international journal papers(I didn\'t check for the citations in China, and I think that won\'t count too much). I have a USA pending patent. No big awards(only a little big one in China).

I think I can try for EB1-or, but I don\'t know how much is the rate for success. You know, university only let you to apply for one category, and I can\'t apply for EB2 and EB1 at the same time. My application will be in VSC. Please give me some suggestions. You information is really appreicated. Thanks.

Yes, You can try for EB1-OR. Present your case well with citation to the importance to the work you are engaged in and cite your achievements well, it should work. Cite your chinese awards too.
 
If 3 years past Ph.D

I\'d concur you should reasonably get EB1 OR granted based on your record, but only if you\'ve got 3 yrs. of well-documented research experience in the field past Ph.D as stipulated in the regulations. Some exceptions to this rule had happened, but are increasingly difficult and may be impossible for a person with Ph.D from outside the US.
 
I did do the research in the same field for more than 3 years

I got my Phd in the summer of 1999, Then I came to USA to be a post-doc for 1.4 year, then I went to a company as a scientist. Then because of the recession, I came back to academic. You mean it is hard to get it passed because of my degree is from outside USA?
 
Clarification

No, I meant it could be very difficult if not impossible to waive the INS "3 yrs. of research experience in the field" requirement when your Ph.D is from a non-US school. Once you\'ve got 3 yrs. of well-documented research in the field in the US, you should be OK. It looks you would have to wait a few months till fall 2002, so that this criterion is met when your case is filed.
 
Probably need

to wait even longer since the company experience may not count to the 3 yrs if not doing research in the same field.
Need to build your case such as getting a nominated membership, a better title...

Yes, if the company experience was not in well-documented research,
this time period may have to be excluded from the 3 yrs. count.
