Guys,

I am thinking of moving from AOS to CP. I have gathered information from related emails, i still have one question very important to make this decision. I belong to Chennai consulate and cannot do ACI40.

Question:
I read that before approving the I824 they send us a letter to confirm that we really want to move from AOS to CP. Do they send us the letter for 100% percent of the cases, were there any instances where they did not ask for confirmation but directly approved the application. Please let me know of any experiences you heard related to this.

Also, those who did recieve the letter (probably sent to the Attorney) how much time do they give to respond? What does the letter look like?

>> You'll need to file I-824 at INS,just to initiate the switch from AOS to CP.On approval,INS will forward your case to NVC and send the Approval Notice to you/attorney.And then if you had filed for I-1485 as well,then NVC will send you a letter,asking for confirmation on choosing the CP path.If you choose to go for CP then you will send the signed letter back to NVC.Or if you wait for I-485 approval.
