my labor was filed in may 2006 (6th year finishes on dec 2006) under perm and just got approved. I have a question. I have recently heard that my perm labor should have been filed atleast 365 days prior, now even my labor is approved I have to leave after my 6th year completes. Is this true?

I really appreciate any help in this matter.

So if my i-140 gets approved, it does not matter whether my labor was filed before 365 days of 6th year completion or not.

also please let me know what is the time frame before which one has to file for 7th year extension.
 
Yes, if your 140 gets approved, you can request for 3 year H1B extension. If you want to be absolutely safe, you could file H1B also in premium in addition to 140 premium. One of my colleagues was similar situation like yours where his H1B was expiring in this sept and didn't have 365 day window. Luckily he got his 140 approved (premium wasn't available when he filed) in Aug and immediately filed for 3 year ext and it also got approved recently.

skill level -II

My labor has skill level mentioned as - 2. does it means that labor was file under EB2 category?
