Hi All:
I am a full-time employee in a medical school, for which I hold a H1-B visa. Meantime I am doing consulting service for another medical school (teaching online). My question is if I need another H1-B for teaching online (I am an Canadian) :confused: ?. Thanks.

Be careful! you can only have one H1B at a time and you cannot get money from multiple sources under one H1B. There may be some ways to get the money because these two are both universities. So some paper work may be needed to somehow get only one check from your primary school. You need to talk to university HR. Otherwise, you are not allowed to get two pay check under one H1 from 2 different sources.

This is NOT correct. You can indeed have multiple concurrent H1's. You just need to check Section "d" in Question 2 of Part 2 on the I-129 Form which mentions your new H1 is for a new concurrent job. Also I suppose you cannot have more that one full-time job. So your concurrent H1's would be for part-time positions in which case you would need to specify the number of hours in Question 6 of Part 5 on I-129.

Having said that, I think you should investigate Canadian-specific rules. As far as I know, Canadians may work on TN-1 permit instead of H1-B. But I am not sure what the regulations are for TN-1 and possible concurrent TN-1/H1.

You can have multiple H1bs, or multiple TNs, but you cannot have TN status and H1b status at once. You can hold multiple visas at once, but you can only enter the US in 1 status at at a time. [Note the difference between "visa" and "status".] Since TN is not a visa, it is just a status, if you enter in TN status, this will void your H1b status. Your H1b visa will remain valid, but your legal status will be TN.

Thank you very much for the information. I need to keep my H1-B status, since this is my full time job (also my employ based GC application). Meanwhile I am teaching online for a long distance program. I am not sure if I need any authorization for this, if I do need, I think I probably have to get another H1-B. TN visa doesn't sound fit (I can not change my status to TN) :confused:

It sounds like you've been working without authorization. You need a work permit for this to be legal.

The other school's legal person has no idea how to deal with my issue. I am not sure where to start now. Shall I hire a lawyer? Thanks.
 
If you are not comfortable filling out these forms yourself, I would recommend you find a lawyer. Most people take a lwyer to handle this stuff.
