I want to know can I do like this.

I am on h1 and with out job for 150 days, now I want to convert to H4. Can I directly go to India taking all my husbands payslips, and w2 forms to get h4 stamping in India.

Or should I have to wait here until, my husbands employer files H4 for myself and then I have to take that paper and get stamped in India.

Can't I go directly to india and get H4.

do they ask my pay stubs if i go to india for h4 stamping

---- Your husband employer has nothing to do with your H4 he or his lawyer can only help you to file COS, you should file form I-539 Change of status from H1b to H4 based on your spouse H1b once COS is filed you can get H4 approval from USCIS with new I-94 attached till your spouse H1b and you will be on H4 status and can remain in US till I-94 expires or can keep H4 extending next time when your spouse file H1 extension. Later when you go out of USA you can get H4 visa for reentry to US( I will go with this option if i am not planing to visit India in 4-6 months)

---- You can do that, take all required documents from your spouse side for H4 visa stamp

---- I don’t think they will ask your pay stubs for H4 visa they will ask for your Spouse pay stubs and if it is Chennai or Bombay consulate in India then they can ask anything and you will not know what they need unless you apply for H4 visa stamp
