Hi,
I have to travel to Cananda. My H1 stamping has expired but have valid 1-94 till Feb 2008. I have AP receipt but AP not approved yet. I have 2 questions:

1. Can I reenter US based on valid I-94?
2. Will it impact my GC process?

>>You need a valid H1 visa to enter the US. You will surrender the I-94 before you leave. You will get a new I-94 when you enter.

2. Will it impact my GC process?

>>Not if you enter on an H1-B visa. However, since your AP is not yet approved, if you use AP you are abandoning your GC process

Thanks for your response. However, I will be using AVR - Can reenter USA from Canada on same I-94 without surrendering it during exiting USA.

AVR rule has not changed. Please confirm.
