Dear forum members,

I got my GC last year, adjusted from asylum. My original NP, with which I came to the US expires this October. I have not been to my home country since I left in 1998, but my now 10-year old child is still there. I was not planning to renew my NP, since I can not go back to my home country, but there are so many things that I need to do even from here as a parent - any official documents, letters and permits for the child need to come from me, be issued by my consulate and validated there, my identity confirmed by my NP. By the way, I even traveled on my NP last week for the first time in long time - to see my daughter in a third country, first meeting after 9 years!(The RTD for which I applied in Feb 2007 still has not arrived). It was heartbreaking to come back and I realized even more that I need an NP for multiple reasons, major one being a parent of a child who still resides in my home country.
My question is: is there any problem with passport renewal for those of you who are from a similar country? I asked the consulate what is necessary for passport renewal and they gave me a pack of docs to fill out to register with the consulate first as a permanent resident. Tons of papers to gather and have verified in home country, even including the letter from my parents that they do not object to me staying in the US(!) What if in this process they find out that I am an asylee and if they have problem with it, I will not be able to get a new NP?

Anyway, I would appreciate any suggestions that anyone could have for my situation.

Thanks as always.

Well, I guess it all depends on which of the ex-USSR countries you are from. We are from Russia and there were no problems when we renewed our passports in back in 2002 (at that point we had asylum from IJ but it was being appealed). Right now, I am renewing my passport again (it's actually expiring tomorrow) and there were only three forms I had to fill out. However, it was just for the passport -- I am not registering with the consulate yet.

Also, do the forms ask you how you came to be a permanent resident of the US? If not, then don't even mention asylum. We just applied for our GCs but based on what Russian consulate told us, my status on the form is "permanent resident of the USA awaiting green card".

P.S. Yeah, I can totally relate to missing your family. I left in August 1998 and haven't been outside of the US since :(

Just want to clarify one thing: we never told our consulate/embassy about our asylum. Since you already have GC, asylum shouldn't even come up. However, if you have to turn in a copy of your GC, be aware that GC has a code that specifies your reason for adjustment (AS6 is main asylee and AS8 is derivative, I think).

It depends a lot on which country you are from. E.g. Russia has not problems issuing new passports to all Russian nationals no matter what's their status in U.S., this includes ppl with asylums, refugees etc.

I guess you should be fine, but as you might know asylees are not really supposed to renew their NP. IO can ask you for your old NP during the interview for citizenship.

It is true only for asylees not for GC holders. Isn't it? because even most cautious lawyers say it is just fine to renew NP... Going to the COP could in some cases be a problem.
But NP? Please show us the evidence or at least present some cases to support your statement. As I understand it duaring the citizenship interview they ask about events after GC?

I think you will probably be fine.
As everyone said it depends on the country. however, the probability of embassy checking the origin of your GC is very small.
Do not tell them about asylum, comply with all their documents and turn everything in and you should get your passport.
Good luck.

Legal opinion on this issue is split.
