Hi folks

I have filed my I-140/485/765 (EB3) concurrently at BCIS and my I-140 and EAD were approved , I did NOT file for my AP at that time.

1. I'm just wondering whether i can apply 'AP' for myself/spouse at either service center/Local BCIS office? Where should i apply?

2. Do we need an attorney to represent us to file AP, like when we did for our other petitions at BCIS?

3. I have read on the I-131 form , they need a brief letter explaining the details of the trip (outside U.S.) ,Does any one has a format for that letter?

4. Lastly what documents do i need/attach along with I-131 ?

Please advise.... Thanks a million in advance..

--- You have to apply first time AP to the service center where your I-485 was filed
2. Do we need an attorney to represent us to file AP, like when we did for our other petitions at BCIS?
--- no need of lawyer, download the Form read the instructions fill up the form

--- You can read it in other thread, just say that you have to vist your parents they don’t care much about the reason given
4. Lastly what documents do i need/attach along with I-131?
Fees Check, Copy of I-485 Receipt, 2 photographs also attach copy of I-94 both the sides

Thanks ginnu bhai

You been giving great advises in this forum, really appreciate it.. I saw the other thread with sample letter format posted by cat&mouse (kind of funny though)

Also, I beleive BCIS sends EAD cards directly to beneficiary once they have approved, do we also expect an approval letter also like they send it for any H1B approval petitions.

Do we need to keep original approval copy of I-140? was it neccessary to have at any point of time during the process of GC ? because the petitioner actually owns the I-140 !!

Thanks once again in advance..

Bhai Saheb!!!
It is better to have copy of approved LC and Copy of approved I-140, or I-40 filling receipt and I-485 filing receipt with you. All the documents help you if you change employer or check your status Online or may have to use AC21 in future.

I almost prepared everything to file for I-131 for both spouse and myself.

One question though ,

1. Do i need to send both applications (myself & spouse) with appropriate documents they needed in same envelope (i am using FEDEX) OR different envelops for each applicant

I have enlosed the following

I-131 Form duly filled-in with checks

1. I-485 receipts
2. I-140 Approval Copy
3. I-94 (both sides)
4. Passport copies
5. Photos (followed BCIS guidelines, same used for I-485, written on back A#, EAC No. of I-485 )
6. Color copies of Driver licenses
7. Formal letter explaining the neccessity of travel ( separate letter for each applicant)

Anything i should take care? please advise

You can send in same envelope but make the package separate so they can find 2 separate fillings and each one should have different cover letter and documents attached and Fees Check at the top.
Write on the cover letter in bold” Form I-131 application for advance parole” write your A # (you both have different A # check the I-485 receipts)
