Please advise on EB1-EA egilibility.

Hello! I filed an NIW application in March 2006, and was approved recently. However, I will probably have to wait for another year before I can file I485. So one thought is that perhaps I can take a shortcut by doing a concurrent filing of I140/I485 in the category of EB1-EA. Here are my qualifications:
(a)11 papers in international journals (5 first-author ones), 300+ citations.
(b)Some news media reports on the research I'm involved in, but my name was not mentioned.
(c)Reviewed two manuscripts for two journals.
(d)One US patent application and several provisional patent applications.
(e)Some professional memerships, including Sigma Xi full member.
(f) No national or international award.
(g) Seven supporting letters, including three independent ones.
Do I have a chance for EB1-EA?

Also will there be any damage to my current NIW/I-140 if I submit EB1-EA? Another not quite related question: my wife's current visa status is H4, if she leaves the country after we file I-485, is she going to have any trouble in getting a re-entry visa? I don't want to use AP before my I-140 is actually approved. Thanks a lot!

1) You need to meet at least 3 of their 10 criteria. Here is what I think:
(a)11 papers in international journals (5 first-author ones), 300+ citations.
Excellent! 300+ citation is impressive. Here you meet one criteria.

(b)Some news media reports on the research I'm involved in, but my name was not mentioned.
You would have to be very convincing for that one.

(c)Reviewed two manuscripts for two journals.
Maybe sufficient. Perhaps you could contact other journals and ask to review more papers. Depending on how you present it, you may meet a 2nd criteria.

(d)One US patent application and several provisional patent applications.
I am not familiar with your field so I can't tell.

(e)Some professional memerships, including Sigma Xi full member.
If there are selection criteria to be member of that group, it is excellent (you would then meet a third criteria), otherwise they may not consider it.

2) EA won't affect NIW.
3) Regarding your wife, I have no idea.

does your wife has stamped H4?
is ur wife going to get it stamped back home?

under both circumstances she can reenter easily
its good to keep AP for backup
if you are not going then she can take her chances
but it shd not be problem!!
 
AMZ you said you cannot file 485....how can your wife get AP??........as long as her H4 stamp is valid she can freely travel......

techy i guess he was thinking of filling Eb1-EA and get AP!!
 
Hi AMZ,
Can you please let us know which service center did you file your NIW? Any REF? When was the Approval Date? We are just trying to figure out some processing times for NIW.

Thanks for all your suggestions.

I filed my NIW to VSC at the end of March 2006. The case was actually transfered to TSC late April. I received the approval notice in Aug. without RFE. My impression is that TSC is pretty nice and the turnaround time is 3~6 months.
