Guys,

My brother is getting married to a USC. He is on F-1 OPT. What documents are required to file for his permanent residence? Could someone provide list of all the forms.

I am currently on H-1B. Can I submit affidavit of support on their behalf or you have to be a U.S. citizen to submit affidavit of support?

In case they want to self-sponsor or self-submit affidavit of support…how much they have to make annually (combined or single) for the purpose of affidavit of support?.

Any comment or suggestion would be highly appreciated.

The following forms would be needed:
I-130 (Alien Relative Petition)
I-485 (Adjustment of Status)
I-693 Medical Exam
I-864 (Affidavit of Support from your Brother's wife)
I-864A (if your brother has any income and if he reside's with his wife, i.e. can be considered as member of household)
I-765 (Employment Authorization document, needed if your brother plans to start working)
G-325A (Biographic form, to be filled by both your brother and his wife; need 4 copies each for both ur brother and his wife)
I-131 (Advanced Payroll, needed if your brother plans to travel outside US before his AOS is approved)

You brother's wife has to be the primary sponsor (irrespective of her income). If her income doesn't meet the poverty guidelines for 2003, then either a member of her household can file an I-864A, or you can get a joint sponsor who would need to file another I-864 (Affidavit of support). A joint sponsor has to be a USC, so you cannot submit affidavit (since u r on H1B)
