Please advice!!!

Labor approved on Oct. 2000. According to labor, required qualification is Masters with 3 years of Experience OR bachelors or equivalent with 5 years of experience.

Filed I 140 (EB2) but was denied, because my education is 3 years diploma (Have educational evaluation letter saying the course of study is equivalent to bachelors) and 7 years of experience before filing labor.

Filed I 140 (EB3) using same labor, got approved.

Can the education issue be problem during AOS or CP
