Hi,

My wife's H4 visa was refused . they refused for the following reason :-
-----------------------------------------------
1. Principal's certified or notarised state and federal tax returns for the last 3 years, including 2002.

2. Orginal w2 and paystubs for every year that the beneficary worker has worked in the US.

My question is , what exactly i have to send for the question No.1 ? I filed my tax returns with HR-Block ? And HR-Block have provided copy of filing of Tax returns to me ? is this is the one i have to notorised ?

And my another question, is even though i arrived in US at year 2000 , we actually got start getting pay stub from middle of 2000. So if they are asking for the every year , I have worked here , what should I do ?

I am really upset here, so please advice me ?

You can submit the H & R block copies of Tax to the consulate , They are acceptable .

They just want to ensure that your H1b status is fine and you have not violated any of the conditions . Basically that your W-2 and LCA application amount Match

I have another problem . I filed tax return for 2000 , by post mail . And i don't have any copy of that ....!

Could you please tell me if it is a problem, if I send only w2 and paystubs from 2000 to current year & HR block filed tax return for 2001 and 2002 year ?

One can get the copy of tax filing papers and other evidence from IRS that you paid US tax. You have to fill up a form. For past 3 years record it is free and for more than 3 years you have to pay the fees. Go to IRS website, find the form# or talk to IRS for your tax records copy.

Do u know , which form to fill for this ? And how much time it will take to reach me ? Can i collect from the IRS office directly ?

---- I don’t say that you will have problems if you don’t send tax papers of 2000, I just replied that one CAN get the tax records.
Go to www.IRS.gov
Fill up the IRS FORM 4506
And Request IRS for Copy OR Transcript of Tax filed with them

I think you can also visit local IRS office, better first talk to IRS on phone and note the phone# from IRS site
 
ginnu, as u mentioned i called my local IRS office and asked for the copy of tax filing papers. The person who attended they will send the papers by post . And 2 days after i got the papers from IRS, Ohio.

But it doesn't look like the FORM 1040 , which i was expecting . its computer print out from there database. it is mentioning all the information like Total Income, tax/TPR, total payments ,wages, taxable interest income, adjusted gross income...like tht few more...

And its hard to distinguish which year each paper belongs..i have asked for past 3 years....Even though i am able to distinguish which year each of these are...

So my question, can i send these papers to india for my wife's h4 visa ?

Is there any problem ,if i send HR block copy of past 2 years,with these papers ?

Whether I have to send orginal paystubs and W2 ?

Please advice !

---- Send the Copy of all the W-2 and copies of Pay stubs. Your spouse should show Only what is ASKED.
 
But ginnu, I was talking to one of my friend, he was telling if it is from Ohio , it will be only Federal. And again it is not like any of the forms like 1040. Is it true ? If so, how to get state and federal tax returns ? Whether i have to fill form 4506 and send it again ?

Please advice !
 
They are called Tax Transcripts and Chennai Accepts them, they donot care about State because they will get the amount you earned in this return and thats all they are looking for, i sent them for last three years in the same format and they issued my wife the VISA, please look at my other posts for details about my wifes case

Zipper, thanks for the info. Anyway I got state tax returns from my state . So I have send my orginal + copy of W2 for last 3 years and notarised copy of my last 3 years return , both state and federal .

I am confused by the above sentence....

I have send orginal paystub from March 2002 to current month . Could u please tell me , is it ok (as in chennai consulate web site , they are mentioning "submit the pay slips for the current calendar year " )

or whether i have to send paystubs from 2000 , the year which I came here ?

If I am in your situation I will send my all pay stubs let them ask what year they need and show them
Form 4506 is for Tax Transcripts from IRS and it is free for last 3 years tax records. If you need the copies of all your tax papers then fill up the form 4506 and pay the extra fess read the instructions on the Form. FYI the tax record you got is acceptable to any consulate. I feel that you are too much worried if you want peace of mind get the Tax transcript or all the copy of your tax papers by paying fees( about 23 0r $25) to IRS read the form 4506 and do some work.
 
problem is i dont have paystubs for few months in 2000, since the employer was not paying salary (company was start up company) but just survival money .

Is it going to be problem ?

---- If you apply Visa in Chennai Consulate it may be Problem, they check all the W-2, LCA and H1 or H4 has been denied to many.
 
Raj2010,

I will advice you to send the tax return documents that you have and all the W2's and paystubs. Obvioulsy if you do not have the paystubs for the initial few months, you cannot produce them now, so stop worrying about that. However, please be careful that your wife does not mention this fact herself. Concentrate on what you have.

I am pretty confident that your wife will get the visa, once you send the documents that you have.

Since i don't have my paystubs of my previous company, for first few months , I was thinking , whether she have to show all the paystubs which we have now ?

Or at first show only the past one year. if they ask, show the paystubs for that year?

or is it good to show all the paystubs at one time itself ?

I am worried , about it ?

What you suggest ?

Please advice !

My wife got visa stamped last week..Thanks all for the advice and special thanks to SERTA2002 too....:)
