Please Advice.......

I recently got laid off. My RD is 10/17/2001 at VSC. I am not able to find a job in this area but I found an opportunity in west cost. If I take that opportunity and keep my current apartment ( do not change my address) , will there is be any problem with my 485. Do I have to transfer my case? If no, would there be any issues if an RFE is issued regarding my employment. Any input be welcome.

as long as someone would watch out for the docs that INS will be mailing to that apartment, i dont see any problems.

i've had co-workers originally in the east coast and were transferred here in west and never informed INS of their address change... as so they claim, no RFE, no problems...

but its up to you and depends on your situation on how things might work out well

I don't think there is anything for you to worry about. AC21 should automatically kick in since it over a year since your filing. There may be an RFE, but since you have found an opportunity (in the same field, I suppose) you should be fine. You can get a letter from your new employer in case of an RFE. Be sure to stay in status though!!! Renew your EAD if on one; apply for H-1 with new company (and EAD) if you don't have an EAD... For all one might know, there may never be an RFE generated in your case.

According to me, there is no necessity to transfer your case and keeping the same residence as before should help in not opening any can of worms.

Thank you guys for your response. just wondering if anybody can clearify this situation:-

I-485 pending. Laid off for the past 2 months(180 days already passed). Have an EAD. Got an offer letter for future employment. Meanwhile got an RFE for employment and paystubs.
Could one use future employment offer in response to employment and pay stub RFE.
