I have been to AMerica before and been out of status for sometime. Now I am back home. I've been chatting to a guy of American descent, and seems like we have a lot in common. He's coming over to see me and if like each other we might get married. Are there any risks involved? Will I be able to go back to America with him? How long would it take? Would consulate think of it as a sham wedding?Please help me, guys. Thanks a lot in advance.
 
Your previous overstay spells trouble for you. You may need a waiver during your immigrant visa (or K-1/3) processing at some stage. I am assuming things go well with this American guy and you two decide to tie the knot.

Thanks for the response. If the waiver is filed, would they let me be with him.Believe me that is something that bothers me the most. I dont want to be stuck up here once I am married to him. How long would it take for me to go to the U.S.? I am in India now. THanks again.

Hi:

Your overstay may or may not be a problem. The inquiry is usually into HOW LONG you overstayed, barring any other issues. Since you do not mention how long or under what conditions, someone cannot even vouch a guess.
