Please advice w/t Visitor Visa Extension

Hi,

We applied for Visitor visa extension for my mother-n-law on Feb21st. Her i-94 is expiring on May 11th. I wanted to extend her visa until July 10th so that she can see her daughter's graduation walk.

My question is: if we wont hear anything before May 11th from USCIS regarding the extension, can she stay till she hears from them or she needs to leave before May 11th?

Her application is at Vermont Service Center and we got a receipt stating that they received on Feb 21st. Any clue how long it could take to know the result.

it's better for her to leave before May 11th if she didn't get approved by May 10th......I applied for my mother-in-laws on March 10th with VSC.......her i-94 expires May 26th....
please post the result here when you get an update.....

The validly filed I-539 extends her "period of authorized stay" and does not count against her for unlawful presence. If the extension is denied, she may be told when to depart by or not. Unlawful presence will begin to add up from the date of denial (or expiration of I-94---whichever is later) but no bar is invoked until she stays beyond the allowable limt. Usually if one departs within 30 days of getting the denial (if it is denied---it could be approved) by the I-94 expiration date, whichever is later, it won't do any harm and won't be weighed negatively at entry on future visits. If it is denied she should keep the notice and bring it with her on her next non-immigrant visit.
