Hi,

My h1b visa with my current company is expiring on April,2004. Is there any time limit, by which I should apply for the extension. Is that ok, if i apply on January 2004 for extension ?

Why are you going to wait till January? File 6 months advance and may get renewal early because at this time many service center are taking 6-8 months to approve the case
nothing wrong if you file in January 2004

Thanks ginnu ! Why iam delaying is I am planning to visit india on Nov,2003 and come back on Dec 1st week.

Is it ok, if i apply for extension now itself ,and visit india with my existing i-797 ?

And again ,I have to stamp my PP with this existing i-797 , since my PP visa stamp expired feb, 2003 (it was of my old company).

Please advice me !

-------- You can apply now; the extension in same status is not abandoned if one goes out of US. Or keep the H1 extension papers ready and send the package to BCIS when you return from India December 1st week. It is up to you

Are U sure about this? Previously if you leave the country, then the h1 (after approval) would be forwarded to the concerned US consulate. (The I94 is invalid by then)

Did they change it?

--------- Don’t take the unnecessary tensions, File H1B extension when you come back, you have enough time. Still If you want to file H1 extension with BCIS you can send it before you depart US, your extension papers should reach BCIS before the date you depart because extension can only be filed when you are in US. For more info read the above MEMO
Regarding the H1 stamp from India I don’t see any problems but if your salary was paid less than LCA you may face problems if your consulate is Chennai, many have been rejected visa stamp in Chennai who cold not produce the W-2 that match with minimum LCA salary if they were on BENCH, TABLE or Chair and were not paid by employer. If you don’t have such issues and present the entire required document you will get H1 visa stamp, Remember I am not working with US consulate and nobody can give you any guarantee

Is it Ok if I use DROPBOX service, to stamp H1B visa on my PP of new company . I had visa stamp of my previous company. it expired on February 2003 .

Rules have changed recently and I don’t know your consulate where you want your H1B visa to be stamped. Do you think I get dreams where you want your H1B to be stamped? Check the site of particular US consulate and find the info or read other threads related to your US consulate and experience of others. I am not working in consulate and unable to guide you.
