Please Advice: filing new perm when Non-RiR is still pending in BEC

Hi,

Have an non-rir PD 03/2004 pending with D-BEC.
(have 4.5 yrs IT exp before joining this company)
Graduated with MBA in may 2006.
Can I file a perm case in EB2 and retain the old priority date ?

What is the best way to go about this ??

Any thots/hints/links much appreciated.

Will the job requirements be identical with the pending LC if you want to file a new LC? Will you be subject to the visa retrogression if you file a new EB2 LC with a new PD?
 
yes, am from India, will be subjected to retrogression. after looking around am thinking that we would have to file LC for a different job requirement having tech degree/exp + business degree/exp ;

thinking that, after getting both the labors certified, do I-140 for retaining the old PD.

Earlier LC had BS + 3 years experiece as requirement for the job.

correct me if am wrong.

Sounds a good idea to file a new PERM with different job and new PD and then retain the old PD after the pending LC gets approved.
 
could you please let me know the rule/article/content which says about the retention of the old pd once its approved ?? employer/attorney are ignoring the old case...

Inorder to retain the oldest PD, do we need to have both the eb3 labor plus its 140 certified and eb2 labor + its 140 certified ? Or just both the EB2 and Eb3 labor certified and file common 140 with these certified labors ???
