pleading gulty for shoplifting

hi all,

I am in a big big big trouble.some of you remember me from my past post.

here is my story.

I am poltical asylee leving here America for 14 years. I got my green card 3 years a go. last year my father was sick and went home to see him, and I am glad I did. I am not regreat for that because after i came back my father died :( it was very hard for me . so when I came back from my country, I have all the documents for my citizenship interview to show why I went my home country. between this I made a big mistake I shopelift value of $30 and got cut it was sears. the store never called the police anything but they told me the police will call me soon which is did after 3 month later and gave me a ticket the same day he walked with me to the court didn't know about that I have to be court that day. he told me to plea gulty and I did. no fingerprint taken no picture also taken.I called my immigration lawyer right away after the court and told him what happend he said don't worry if they didn't arrested you and didn't take a picture i should be okay. but I know I shouldn't plea gulty. I am so depressed and sick. I feel bad what i did.
so today I went the second court date, the judge told me to do 72 hours comunity service, 6 month probation some economey class and my case will be dismissed. I know for INS this is nothing.

what should I do guys? do you think when I aply for my citizen the will deny me and deport me? somebody told me that if I pread gulty for anything that is deportation. please guys tell me what should i do?

I think you should be honest to tell INS like what you wrote now. Depend on your luck. Maybe he will forgive you if you show your strong will to be a good citizen.

i think you are fine, there was no fingerprint or picture has taken, you were
not arrested nor handcuffed,

there is no criminal record,

dont worry, you are fine

you think so? a lot of people saying I shouldn't plead guilty.

what do u think about that?

they have anything, tell them true things.
 
You should not be giving advice. Shoplifting is a CIMT, law enforcement normally is not required to fingerprint, photograph or handcuff a criminal. The fact that he was convicted, means there is a record someplace. If they have his name, birthdate, and social security number that is all they need.
ICE will not deport a Aslyee for a single CIMT, but he needs to avoid doing anything more, at 2 he will be detained by ICE.

In a situation like this, failure to disclose is more serious than the underlying offfense. Full Disclosure.

I am not convicted the case will be dissmissed after I finish the commynity service and the probation. I am just looking information if anyone have similler situation. I know shoplifting is a crime. I didn't plan to do it. I feel horbel and I am paying the price for what i did.
for your information, any crime you do you have to give a fingerprint and pohotograph but you don't get handcuff if you cooperate with them. I am just being lucky and i admit right there and they just let me go.

I will do anything to fix this..

you are in very dangerous water here. Under the immigration law the word conviction has very broad meaning. A technical conviction is NOT needed to trigger immigration consequences. Do yourself a favor and get a lawyer.
 
here is how it works guys, the terms about criminal record is different in immigration law and criminal law. if someone was not formally convicted of a crime or didn't receive jail sentence but got away with some probation, supervision, defered program, fines or community service, then any one of them is a conviction under immigration law.

in immigration law, mere admiting of a crime is a conviction and can be subject to detaintion and deportation. once you make a plea deal , that is a conviction and you maybe detained and given a court hearing for removal at airport .

the point is, you never ever make any plea deal when you are charged with a crime.

i got arretsed with 2 crimes but both dismissed without having to go to a trial. i i paid no price for the crime i got arrested and charged with. unhappy about tha arrest records but happy i have no convictions.

Mr. happy: the best time to get this straight is while you are in the process of the court system. You should have asked the judge about your status or read thoroughly the document you were given as a result of your conviction. I once helped a guy who was caught shoplifting. He was a first offender and went through the deferral process. At end I asked the panel who were listening to his case about his case. And they told me that anywhere he encounters the question have you ever been convicted of any case he could answer no. But I think in your case you have seen a judge who convicted you. It was bad idea for you to plea guilty in the first place and second to go through the court system. As first offender you were illegible for deferral. Anyway you should not worry. I know many individuals who committed greater offenses and got their citizenship. Just be honest keeping going. It is not a big deal

They would pot you in handcuffs take your fingerprint , picks report ------get you in front of judge , you plead guilty ore not guilty ,judge will give you sentence .......................In your case you got nothing --------- the judge told me to do 72 hours community service, 6 month probation some economy class and my case will be dismissed.
You only had a ticket you were not arrested ,having tickets is not mean being arrest .
Remember this is USA asp after you get taken fingerprint and picture you are convicted ,mean you are under arrest, than chit going to hit the fan . Than you have to worry not in your case. .
After your case gets dismissed , it will vanish only FBI can check it in some emergency case. right now relax and do what judge said , they know that young peeps doing sometime stupid thing,everyone man/woman everyone once in life thought about it including judges , its part of growing up.
Relax enjoy life in great USA.

I suggest you to go to DMV to get 10 years driving Record. It shows if you were arrested or not. You can see if there is a record of it at once.
 
some are giving very bad answers here. you may not pay a price under criminal law for such small minor crimes but under immigration law, you can be subjected to detaintion and deportation. once you make plea deals which comes after admitting the crime, that can be a deportable offense under immigration law.
if you are a citizen, than you pay price only under criminal law but untill, u got citizenship, you have to obey all immigration laws and you can be deported back if you have criminal conviction records. just look behind the last page of your travel document.

any immigrants who has GC or non GC legal immigrants, if they have criminal convictions in their record, you will be questioned about your crime and might be given a notice to appear NTA at immigration court for removal hearings.
immigrants who has minor criminal convictions on their record will have very hard time being admited to US at port of entry when you come back after internaitonal travel..
they are sometimes immideatly denied entry and get sent back on next plane.

many misdeaminor crimes are deportable offense.

so all immigrants should be very careful when being charged with a crime!

Hi, I am a female 29 years old sorry for confussien. probably can be vanish but I plead guelty which is I shouldn't have do that. the police told me to say that. they didn't even give me a chance to talk to my lawyer. I am about to die here :(

Hi jonny1, thank you for your info. are you saying immigration will call me to appear the court? are you serious? Oh my God I don't know what to do. I am so stupid and mad a mistake.I did a lot of good things in this country. I work march and dimes, cancer society for free valanter works also just graduated. please give some advice if there another way i can change my plea guilty. I am on probation and doing my community service now. also I am on defferal program. please tell me what should i do. my immigration lawyer keep telling me every thing is going to be ok..

is that anyway or is too late If i can change pread guilty to not guilty? when the police called me after 3 month later, I was so scared and met him at city hall and gave me a ticket and told me that he is going to walk with me to the court because it was 2 min from the city hall.. he also told me that since i took the neckless just admit and plead guilty i said ok. so the judge asked me to plead guilty or not I said guilty. I have no idea about the law and scared. I am so messed up. please guys help me on this.
