I have got my plastic green cards and want to take the time to convey my whole hearted thanks to this entire forum. You guys are truly awesome and without the timely advice from this forum, I would not be where I am now.

I also wanted to throw some light on my case which might help answer many questions.

I took a internal transfer and moved to India in Oct'03 at which time it was beyond 180 days of AOS and also I-140 was approved. My H1B was cancelled by my employer immediately after I left US. I did a form AR-11 and sent letter to INS for change of address to my friend in US round about December timeframe.

My AP & EAD were expiring May'04, so entered US in Jan'04 using my AP only(no other docs required at POE) and applied for the renewals. I left in 2-3 days time for India. I got the AP & EAD approvals pretty quickly and without any questions.

I made yet another trip to US in Aug'04, this time for Green Card stamping. Again without any hassles at POE and just the AP was needed. Please note that the AP I used to enter US this time was approved when I was out of the country. I have seen hundred of queries about being out of the country when AP gets approved. I am a pretty good example that there should be no problem there. I was not just out of the country for a visit but had actually moved out of the country and was able to use the AP approved when I was out of the country to reenter.

I am now transferring back to US and have also got the plastic green cards.

All the time I was out of the country, I used my friends address as the address on record for INS and it worked out well for me.

I wanted to share this experience which is sort of unique I guess and might help answer a lot of questions.

Maybe you were lucky .... check these instructions taken straight from the AP form ( its attached as an image ).

Looks like you should not leave the US before getting the AP issued.

Anyways, good that you got lucky ! -- others reading it should be more cautious.

Let me draw an analogy :rolleyes:
Yesterday and today I drove over 100 miles/hour in speed limit 65 miles/hour zone and I did not get a ticket. I am a pretty good example that there should not be any problem there. I was just not driving over the speed limit, but had actually drove in a speed that results automatic revocaton of driving license in California.

Make sense??? :cool:
 
This is still a good information. If people are out of other choices, at least they still have some hope to try even there is no insurence here.
 
This is a little misleading.

You already had an approved AP that you were using when you were out of the country. The new AP was applied for and approved while the other AP was still valid.

The situation is totally different when you do not have a valid AP and you are out of the country and you apply for it or it gets approved.

Murthy had covered a situation similar to this. The issue was that when you apply for a renewal of AP does it automatically cancel out the current AP. According to her that was the possibility and that one couldn't leave the country if they had applied for a new one as it may void the first one. The interpretation she got from uscis is that the renewal would not impact the current valid ap.
