Planning to apply for Citizenship need help..!

Hello,
I am GC holder, I got my GC in 2000 sep. I returned back to my country (India) in 2000 Oct for continuing my studies with the help of Re-Entry permit. After completing my studies I came back to USA in 2003 Jan 15th which is almost 2 yrs 3 months. I wonder when I will be applicable to apply for Citizen ship.

In the USCIS web site I saw an example which is given in Naturalization guide as below. Based on the example below I calculated for 4 yrs 1 day where I should be applicable to aply by Jan 2007 16th. So any body who are proffessionals in this perticular case think Can I apply now. Is it valid thing or not.

“Continuous Residence” Example
• An applicant became a Permanent Resident on January 1, 1994.
• She lived in the United States for 3 years, then returned to her native country for 1 year and 3
months.
• She got a Re-entry Permit before leaving the United States so that she could keep her Permanent
Resident status.
• The applicant re-entered the United States with Permanent Resident status on April 1, 1998.

Question: When is the applicant eligible for naturalization?

Answer: On April 2, 2002, 4 years and 1 day after she returned to the United States. The last 364 days the applicant was out of the United States count toward her time as a Permanent Resident in “continuous residence,” but the 3 years in the United States before leaving do not count.

I was in exact same situation. Came in May 1998, went back with re-entry to complete the college and then came back in March 2000. Applied for Citizenship after 4 yrs and 1 day from May 1998.

Hi Amishah,
You have mentioned that u applied for citizenship after 4 yrs and 1 day from may 1998. Is it mar 2000 or may 1998. Bcz you went out of the country in may 1998 and returned back to USA in March 2000 where u can apply in March 2004. Also in ur signature every thing is describing about green card application but u say that u applied for citizenship. Please correct me if i misunderstood u. Also did you got ur Citizenship.

Didn't mean to confuse you. I checked my documents just to be sure. I applied in March 2004. 4 years and 1 day from March 2000.
My signature talks about my husband's GC application.

Oh great, thank you once again for confirming with my doubt. I do have another question, that I married to a girl who is in L1b. Her L1b got in aug 2005 and expires on Aug 2008. I married her on Aug 2006. So when I am appling Citizenship, Do I need to mention any where that I am already married. Also After my citizenship, How can I apply for her GC or USC dependent. Any idea.

Do you know what are the documents that I need to submit while i am appling. Do I need to apply FD-258 along with N-400

I don't remember if you have to mention your spouse information any where in the Citizenship form or not. But even if it is asked anywhere in the form then there is no harm to mention it. It is a very simple form with very detailed instructions on it. You can go to USCIS.gov to get that form.
Once you become a USC, you can file for your spouse GC. You can get forms for that on www.USCIS.gov too.
I am not aware of FD-258. I did not fill that out.

Sorry for the FD-258. I mean Finger prints application card along with N-400 form. When do we need to apply for finger print application card.

You don't apply seperately for FP. You will have to pay fees for FP with your N-400. Just take a look at the form. It will explain you everything.

Sure thanks for ur reply. I have another question. When we apply for N-400 and when we attend the interview, do we need to show the re-entry permission passport also. Bcz i think it is in India. Did u show ur re-entry passport with your nativity passport.

Yes you need them with you at the time of interview. They will check for your entry and exit stamps in it.

In the form thay are asking about the total days iam out of the united states in the past 5 years. As i told you in the earlier i came to USA on jan 17th 2003. and the whole 2002 iam in India. So do you think that do we need to add the days in 2002 also if so my total days are 156 days from 2003 to 2007 and 364 dyas in 2002 which is 520. Do u think is it fine

Yes you will have to. Since last 5 years from 2007 needs to count 2002.
 
You have to declare your marital status on your N-400 and it will ask for details about your spouse, including her immigrant status.
Once you acquire US citizenship, she can apply for AOS.
