Pl Help :: venkat97 is in big trouble :-(

180 days passed by Feb 17th 2001. On bench now. No pay check from sponsoring employer for last one month. Applied 485 in August 2000 ( VSC ). I have valid EAD. My employer suggested me to use EAD get a job and he is willing to hire me back later.

I see possible solutions... per my knowledge

1).Be patient and stick to sponsoring employer, with little hope of getting next contract assignment.
2).Or use EAD and get job else where.

Going for second solution means "Welcoming future problems????".

Gurus please post your opinions...

If you don\'t get RFE, then first or second option doesn\'t matter. In this case, your second option will help you financially as you mentioned you are not getting paid for last month.

Your first option will be risky, if you get RFE for last 2 months paystubs (I have seen Vermont sending RFE to many of us). So if INS asks for your last 2 months paystubs and if you don\'t have them, then you will be in trouble.

Second option will work fine. It will work better if your current employer is ready to give you a letter, indicating he is interested in hiring you after getting GC. In this case, if INS asks for paystubs then you an send paystubs from the new employer and if INS also asks for the employment letter, you can take it from your current employer.

So ideally you should get a job on EAD or ask your employer to pay you so hat you will have all the paystubs and will be prepared for the RFE, in case one comes in your way (Hope you will get approval without RFE).

Thanks Vinayak, based on VSC approval speed, my turn may come in 3-6 months from now ( 485 ND Sept 12th 2000 ). Financially I am OK ( Thanks God. At least my wife is working on EAD ) for now.

I am just thinking of "replying RFE" ( if VSC issues ) and PP stamping steps. Per my understanding none of us experienced PP stamping after taking advantage of 180 days rule. I have seen some postings in this board saying that "they are preparing to reply RFE with pay stubs from current employer and letter from Ex. employer".

Bottom line is there are no regulations from INS yet. There are no such cases for which INS accepted RFE reply from people, who took advantage of 180 days rule. There are no PP stamping experienced cases from people who took advantage of 180 days rule.

I am just thinking of these problems before using EAD to get next job.

Gurus, can some Pl reply with your comments on this. I guess there are many folks like me, in this hell situation. At least they get chance to hear others opinions.
