Physical & Continuous Presence

O.K. I need help on this. I will be attending Grad outside the US for about 18-month total beginning May 07. I’m PR through asylum (date of grant was pushed back a year to NOV. 04).

-Anything in particular I need to be doing (beside coming back to the US every 6 mo or less?
-
How would that affect my eligibility as far as physical and continous presence in the US to apply for citizenship around Aug 2009 (I will finish school and be nack in the US by Dec 08)?

As far as I can tell, there won't be an issue for you. If you can do what you described above.

The time you spend abroad will certainly not count towards your "physical presence" in the U.S.
For "continuous" presence, you should be fine, as long as you do come back to the U.S. at <6 months intervals, as you are planning.

Still, I would also suggest getting a reentry permit, just in case.

I am still not clear about the difference bet Phys & Cont. Presence.

In other words, if I leave the US for 18 month in May 07 as I am planning to do (By then I will have been physically present in the US for approx. 30 months after GC) , then come back to the US every 6 months or less, will I be O.K. to apply for citizenship on time (around Aug 09)?

I do have a reentry permit, and that's what I have been using instead of NP.

What do you mean? Of course they will "Total" the time you are absent. But that makes no difference. You said you will be absent for 18 months. You can be absent up to 30 months. So that is why I say I don't see any issue here.

Sorry, but I'm a bit apprehensive, as I do not want to wait any longer.

So bottom line is I'll be O.K. to apply for citizenship on time (around Aug 09) if I return to the US every 6 months or less?

Yes,

(provided your studies abroad will indeed take only 18 months)
