I was married for USA citizen and filled for green card. After 1.5 years my wife filled for divorce and we divroced legally. After that I married my current wife and applied again for green card without leaving country.

Two weeks ago I had an interview and same officer that interviewed me firs time interviewed me again.
On the end of the interview she asked me to write down why I divorced my ex wife, and that she will need to wait for FBI backgrpund check.
Me and my wife have really strong bonafide marriage evidence ( loans,we had big wedding where my family flu from homecountry, honeymoon pictures etc....)

Today same officer called me and ask me to come to office tomorrow morning and after she called again to reschedule for Wednesday.

Did anybody had similar experience? I dont know why they called me again after just two weeks, and it was phone call not official letter that INS send?

Thank you

Since you have a bonafide marriage with your current spouse, you have nothing to worry. Just turn up at the designated place on time. Good luck!!!

I'm sure Triple C is right, no need to worry. By the way, did you receive an EAD through your second wife?

No I did not, actually I didnt applied either.Officer told me on interview that i dont need it now.
But like I said it just was strange that she called me by phone, and only 2 weeks after interview.

But anyway I will see tomorrow and will post here reason.

I just went to appointment and officer told me that since I filed second time for resident status, she cant granted it by law.but if I apply for removal of condition based on my first marriage they will grant me permanent resident status.
Also she gave paper to sign where I am stating that I am withdrawing my petition,I added to that that i am withdrawing since I am already having resident status.

When I was there 2 weeks ago she took my green card and today she returned it to me.

I am really confused. How can I file I-765 when I dont have any evidence right now.All my bonafide evidence are 1.5 year old,and I am divorced. Also should I include statement explaining all this with I-765?

She gave you an I-765 form or an I-751? I assume it is the latter. Just fill it in and send it along with proof from your first marriage and divorce decree. Don't worry about the age of the evidence. They will concentrate on the period when your were with your first spouse. They are not interested in what happened after you got divorced.

I think the officer is making sense. You can not have two cases open for you. At the time you were applying for the greencard with your second, you were legal permanent resident though with condition; therefore, unless you abandon in writing your old greencard they can issue you another one.

I suggest that you follow what the officer told you. Just apply for removal of the condition. They will either grant you or deny. If they grant cool, if they deny, then you can move forward with your new wife;

In short two greencard avenues are not possible by law; one must close in formal writing or legal proceeding before another can be opened. Good luck…that is my two pennies..

Yes after all it make sense to me also.Officer was really helpfull. She also told me that with application include somekind of explantion and she gave me her direct phone number that I can include it,so if they have any questions she can explained them.

After divorce and my second marriage was 8 months, but my wife left me a year before divorce.
