I have a fiancee in the Philippines and her husband abandoned her over 8 years ago. She has an 11 year old son. As there is no divorce in the Philippines, she has to get an annulment. The fastest and cheapest annulment is the presumption of death.
However, we have heard that the US Embassies are not allowing this type of annulment or they perform a very in-depth investigation.
The Philippines will allow her to marry me after she gets this annulment. However, we are not sure that will happen when we apply for her visa, either spouse or fiancee. Will the US Embassy/Immigration grant her visa if her marriage was annulled via the presumption of death annulment?
