I was under the similar kind of Boat a year back. My company A was bought over by parent company B. I still have my H1 with company A. While filing for my labor, my attorney put a press release stating "Company A is bought over by company B.".

At that time there were few collegues who had already applied / got their Labor for company A. But they were able to get their
green card while working for company B.

Case Received 09/02, not approved yet and no receipt

Hi everyone.

My case was submitted from state SESA to DOL Phil
office on 09/11/02, according to my attorney. He said
he didn't receive any receipt from DOL since then.
When I called the DOL line, using employer's phone
number, the machine said that the case cannot be
found.

Should I ask my attorney for a case number (is there
one at this stage)? And at which phone number can
I reach a human being at DOL to ask related question?
Please let me know. Thank you.

Also, I'm thinking of submitting I-140/I-485 by myself
(without attorney) after the LC approval. Is that possible?
Do I need any additional document from employer?

I am in the same boat, mine has gone to dol in sep 02, till date no receipt, no voice mail update. When I called my lawyer, he said - usually he wont receive any receipt from DOL. Just waiting for mercy.

If you can't find case in the system then there might be following reason provided application did reach DOL.

Employer is using different phone number then commonly used in the office. You need phone number which was on LC Application (Part A, section 5).

You can ask your attorney for the case number as it is usually assigned before sending acknowlegement to the attorney.

Regarding representing yourself for 140/485 -- You can do that and no-one can stop you but it is complicated matter and you never know when will you require expertise. Also employer might not give you the financial details which are required at 140 stage. To be on safe side and feel more relaxed about the process, I will hire a qualified attorney even if I end up paying some extra money.

Thank you all for your prompt posts.

Actually the "employer's phone number" I used was given
by my lawyer's office, so I assume it is the correct one for
LC. But somehow it was not recognized by the DOL AVM system.
I will try to reach my lawyer for my case number.

For some personal reasons, I wish to delay the filing of
I-140/I-485 after (hopefully) approval of LC. In this case,
how long can I wait? i.e. How long can that approved LC
stay valid for I-140 purpose?

By the way, I live in VA. The LC situation is better than MD.
But, the I-485 was much better in MD earlier (a lot of cases
transfered to Baltimore and processed very quickly). So, who
knows, good luck to all.

Congratulations buddy !!!. These threads have been very informative and helpfull for lot of folks just because of people like you. Most of our folks are out there on VSC threads. Lately there too it became a waiting game to get the receipts, not as bad as LC though. Applied Concurrently on Dec 19th after a mid November LC approval and am waiting for receipts along w/ our other folks. Please join us all at VSC threads.

Thanks for the update. Do you have additional details like Philly DOL recvd date and approval date etc?...in line with the columns in the excel sheet that we are tracking.

Just so that we'll know if Philly DOL has moved from the 09/04/2002 revd date for processing LCs...the last entry seems to have been that....

I am pretty sure philly has processed some of the 9/17 cases.
The below is the dol email response. I am pretty sure they RIR cases from Delaware.. but don't know EB2/EB3.
