I think we are the underpriveleged people. All the news that comes out ever is about RIR or cases that made it thru to Regional. For the past 3 years i curse my lawyer everyday atleast 5 times without fail for choosing April 30th. One week earlier and i would have got my GC at least 2 years ago.
As you see there is no positive news that i can provide , I choose not to demoralize other people. Just a silent spectator. No ofense to anybody but i hope to be the one providing the ray of hope for all the SWA people very soon. I will ask my lawyer for the 9th year extension very soon and will update the forum with my case status.

oh man, talk about bad luck ... I feel for you, man, I really do ... I think you got the worst possible break ever ...

and I feel so pissed because a friend of mine got certified using a shady lawyer, pretending to be a "fine dining cook", when in fact he can't even fry an egg ... and the sponsor didn't even exist when he filed ... but he got in on the 245(i) train ... meanwhile, our legit applications are subject to this refined form of torture ... Welcome to America !!

I am EB2 RIR Filed in GA Atlanta, I reached to regional office before being sent to Philly.
I have a P number really early P-05013-XXXXX, my PD is Sept2003. Any idea when is my turn to get review by PBEC?

Well thats what I meant when I said that they started the entering the info in the system on 8/12. That means they have started entering the full information.

No concept of EB2 or EB3 in labor

Folks,
Just a reminder that there is no concept of an EB2 or EB3 as far as labor certification is concerned. Where in the world on ETA-750A/B, you mention this - nowhere. So, as far as labor approvals for EB2 vs EB3 are concerned - they are a mere speculation started by someone who does not understand the grass roots.
Although granted that there is an implicit argument for EB2 or EB3 derived from your job posting/requirements, which determines later (in I-140, I-485 stages) in which queue, your adjustment of status is processed. May be I'm missing something in this entire discussion - enlightened ones can correct me.

I tend to fully agree with 'jiangnan' that there is such a mess at BEC that they probably don't bother to look at a lot details and are generally approving cases in a specific date range and are NOT following a strict FIFO order. So, in my opinion, people from these specific months should start to see some more approvals. I really hope that PBEC should pick up some pace for approvals now, and hope that some of the predictions tossed here by aprlc2002 come true.

PBEC pattern ?

Guys, these are a few RIR cases that got certified from PBEC in the last few days. I hope these are not random cases.

If these are not random cases, it's a good sign and right on predictions (PBEC is approving 'fourth quarter 2001 RIR cases' - source: my lawyer's chat with PBEC). It gels very well with aprlc2002 predictions as well. Stay positive!

Can file PERM with existing pending LC at BEC

I beleive the FAQ says nothing about denying the existing LC if another LC thru PERM is filed. If anything it mentions that two LCs even if for different jobs cant be filed using PERM. And it also hints that there is no legality to the action of denying LC pending at BEC if an LC thru PERM is approved, by doing that DOL would only be setting itself up for a massive onslaught of legal challenges.

There is no point having another soul feel the same misery if you are miserable too, so dont be so quick in celeberating any news. If anyone in here even had 1% chance to get their LC approved quicker using an alternate route, they would.

Some Information - Help Needed

My employer called to Philly to ask about my case. From their answer it is clear that they have now a kind of schedule to analyze our cases. The schedule seems to be valid for several month ahead.
Now comes my problem. According the information they gave us, my LC could be ready just after one of my kids is 21 years old and thus he would not be elegible to be immigrated with my case.
I know that when you present the case to Immigration, the age of a minor is frozen for immigration purposes, but it seems the law does not cover the DOL instance.
Do you know, guys, if cases like this could be expedited, or if there is some other way to solve my problem?

Why don't you call Rosslyn at PBEC and talk to her about your case status?

My case status was RIR when i checked with Philly exactly one month ago. I hope and pray that my case status will be soon changed to "Certified"

My case detail: RIR-EB3, MD SWA, PD: Feb,2002
 
Any idea on BEC timeline beyond 2002 cases?

Does anyone here know what can be expected for the timeline of approval of cases beyond 2002?

Many many congrats, my MD fellow! Mine is also Feb 02 RIR from Maryland, but what the heck with BEC? They changed my case type to TR per the screenshot they sent me yesterday! Damn it! Damn it! Damn it (cannot help cursing them).

No case status in the reply

Inspired by you, I sent a mail and like you got a reply in < 5 mins. A month back, I had RIR in the status, but in today's reply that line itself is missing :confused:
