NYS EB3 RIR
PD: March 2002
45-day letter: January 2006
NOF: September 2006
NOF Replied: September 29, 2006
Online status changed to certified: 10/31/2006

Now, waiting for the notification letter.

Is there anything I can prepare now to avoid delays in I-140 and I-485 processes?

Thank you!

Xmmm, Congratulation! get your original birth certificate ready (and your spouse's) rest all documents are usually handy

Also, with EB3 you will have to wail for filing 485 due to retro.

nothing new...

Hey patience buddies,
HOw's everyone? I feel obligated to post a reply here everytime something happens regarding my LC. Well today I called my attorney and she acutally picked up! Anyways I asked her whats the difference btw RIR, NON-RIR, TR, and any other R's out there. She said "I'm busy but long story short RIR tend to move faster then NON-rir or TR". So I asked her if I could convert it to RIR? She replied by saying "this mess will end very soon and where you've waited so long just wait a bit more, but I've no problem with converting your case. I'm sure you'll recieve something "very soon." Because the PBEC are moving faster then before and they only have to provess 50% of the cases (176,000) left to do."

So yeah that pretty narrows it down. Did it help? Nope. Will I wait? Guess I've too.

Thanks guys for all your advices and tips. Lawyer has decided to file my I-140/I-485 with whatever we have. Print out and etc. Can't wait anymore. We have tried every possible ways to beat the horse (PBEC). Faxes, letters, telephone and even contacting local US Congressman.

Anway, wish me luck on the next level.

I wish there really was something that we could do to change that, but we are the mercy of someone who has our file sitting on their desk and all we can do is HOPE.

I sincerely hope you hear something positive soon and i hope our patience pays off and the future steps are not as bad.

I would still consider a conversion. Please read the excerpt from immigration law website:

10/26/2006: BEC to Start Website Reporting of Traditional Case Processing Time Beginning Next Month
- Even though the processing time of traditional cases at the BECs is frustrating, the launch of the website processing times report will allow the traditional case applicants to check the status of processing of cases in the BECs.
10/26/2006: BEC Traditional Labor Certification Processing Time to Remain April 2001 for Sometime to Come
- AILA has reported that the BECs are still processing April 2001 traditional cases for the traditional case track and it is not expected to move ahead for sometime due to the huge number of 245(i) cases which were filed in April 2001.

Moreover there is nothing to loose (other than money, as the case might have been) in the conversion process.

haha.

My PD is 3/2002. Based on the current progress, I think I don't have to wait now.
