How can you say that BEC has all approved, if so why do they create such a bad impression that they have not completed data entry yet?

When US congress introduced Employment immigration in 1960, congress wanted to control the diversification of immigrant population. For example all Indian IT companies hire only Indians. Thats why they introduced the VISA retrogression dates.

VISA dates work off of a formula. In 1999 congress found that there was a flaw in the formula as it was showing VISA's unavilable though they were available. Congress halted the implementation of the formula and ordered DOS to come up with a new formula. DOS gave a grant to a professor of MIT to come up with a new formula.

The MIT professor came up with the new formula in 2003. BEC's have all the cases certified. They just have to send out the certification letters. But they are waiting for the DOS to implement the new formula.

This is a double edged sword. It does good by not allowing PERM people to get ahead of the line. However since US already has a healthy population of Indians and Chinese already, it will take a lot longer for these country dates to move forward. 28% for EB1 (maybe 5% will be for Indians), trust me Indians use up all these numbers. Similarly for EB2 and EB3. These VISA numbers are not transferable across countries.

It means you should have received your 45day letter or should receive it soon ... check with your attorney

Thanks for sharing this article. Agreed that some of us may not be satisfied with the solution Dinesh offers, but to many including me, this proposal provides an acceptable alternative. How can we ensure that this thought gets the attention of lawmakers? Could you try to obtain and post information as to how the rest of us can support this approach?

Has your case reached regional yet ? Could you provide us with details so that it will give us some idea when to expect the 45 day letter ?

Not necessarily....I filed in March 2004(Atlanta) and got my 45 day letter on March 2005.You may get it much sooner...or may straight get your LC..

From the recent postings it looks like PBEC is processing ARR 2002 cases.

Well it depends.... NJ might have sent about 10 boxes of labor applications to PBEC out of which we have heard from only a handful getting 45 day letters. Most of us have their cases partially entered in their database. BEC is very random in sending 45 day letters so I would say nobody has any idea when they can receive theirs..

If it is RIR then I guess your PD is 01-NOV-2002.(this is because NJ has only RIR cases from May'2002 sent to PBEC).

This is completely off-topic, but since the last ~15 pages of this thread have been mostly about the recent cut-off dates, I hope you don't mind.
I've been reading all these sad replies, especially since the new Visa Bulletin came out, and first I was the same, but then I realized that there is a brighter side of the story: This Visa Bulletin has triggered something. We've been sad and upset for long years, but couldn't do anything, because the whole process was way out of our hands and nobody who could have changed anything was interested in doing so. Now suddenly everybody starts moving and acting and I'm 100% it will have a good result for all of us. Just think about these:
- Bill Gates and other IT leaders have been pushing the government to let more high-tech expert into the US; they need us and also realized that other booming countries (India, China, and don't forget about some European countries) could be strong competitors and therefore better destinations for us
- AILA is also trying to do something, because this is their interest as well: There are (few) attorneys, like Rajiv Khanna, who are doing a lot for our community even if there's "no big fire" outside, but now even the "money-hungers" are lobbying, because if we leave, they'll lose their job. I've seen some good starters on the AILA website (they're organizing a national lobby day for September 21) and on ILW.COM (a request to allow filing I-485 even if our PD is not current - we won't get GC, but at least EAD and AC-21)
- in the Senate and Congress there are some bills introduced that would ease our pain. We all know which the best is, but I'm sure there will be a fight. On the other hand, they have to settle the problem. Not because of us, but rather because of the 10,11,12 or who knows how many million illegals. I guess 3-4% of the whole population is big enough to make them do something.
Finally here's something very interesting (some might ironically say "funny") before I wish you all a nice weekend:
