hi Juntha, that's good news ... I have a question for you, I'm in a similar situation (since my filing in 2002, company has spun off, changed name, address, employeer number, etc). Have you talked with your laywers about the impacts of the changes in your application ?

My lawyers aren't very sure what to do ... they say they'll try to prove the new employer is a "successor in interest" of the old employer, either when we receive the 45-day letter or after getting the certification ... either way, I'm really afraid I'll end up in a limbo where I get denied and have to appeal, etc ...

If you get to talk to your lawyers about it, could you post any info here ?! that would be great, thank you very much.
 
Congratulations, Juntha, I am so happy you. It would be so unfair for this country and this forum to lose you.

I think if your lawyer can provide substantial proof of the continuance of the business and it is just a change of name and location, and submit them to BCIS when you guys file your 140/485, it should not be any problem. But since your employers are not involved at the current time(I assume you all received your 45-day letters and your cases are being represented by a lawyer), you do not have to worry too early.

Although we are still not seeing any approvals in a flow, and our life is so much impacted by this long long wait, we should always try to be more optimistic, and more important, do not vent too much of our anger or frustration here on this forum, because anger and frustration help nothing except making ourselves lost our normal mindset and do something unreasonable. I do think Juntha sets up a good example for us here, we should learn from him how to deal with unexpected things, and change our position to all kinds of ups and downs in our life. Be sarcastic is OK, but try not to throw out here in this forum some words that make people here feel nothing but despair and hopelessness. Hope is a good thing.

I am sorry Cantstandit, my last paragraph in my last post is not aiming at your post at all, it was my opinion on some earlier posts today.

By the way I do think Werner did a good thing to help us figure out how we should start PERM if there is such a chance and necessity later. At least I got rid of my doubt about how doable PERM is, and got to know it is not that complicated as I thought before. Werner's efforts here should be appreciated. I think anyone of us would try to find another way out if we can, even if not right now, and it is worth talking about here.

anyone in this forum applied from CT. My LC was filed from CT through RIR on Oct 2004...been reading this forum but did not see anyone from CT getting their 45 day notice or any approved LC's. please provide your input.

The wait...

I'm totally new to this portal and am in the process of going from a H1B visa to Green Card - the application was sent out in March 2005 and I know that now it is at the Philly Backlog Center. Anybody have any advice as to how long the Labour Cert part is likely to take, and from then now long it is likely to be??? I'm pretty sure it's measured in years and not months!!!

May take couple of years

I am also in the same boat. I applied in Feb 2005. I think that it will take atleast couple of years... The BECs have said that it will take them 24-30 months with ADEQUATE resources and we are at the end of the queue. :(

Sure will. Right now I feel like a small fish in a Big sea at 140/485 forums. :)Dont know any of the lingo they use! Will catch up soon. Besides you can always ping me for any Q, if I can help. Good luck to all.

Case Status = RIR (in process) means what ?

Friends

Just now got screen shot from PBEC and case status is RIR. I understand RIR means in process. What does it indicate ? Are they processing my application now ? Means there is chance of salvation some time in the near future ?

I-140/485 for PERM vs RIR

I am new to this forum. Please help me out with my stupid question. Thanks!

My RIR application was filed in 7/2004. So I was trying to get my employer to start a new application with PERM. But they refused to do so. My company's lawyer told me that Priority Date is very important, even just 1 year. Becasue even if I get LC through PERM, my I140/485 application will still be waiting, not going anywhere because of PD.

My question is that all people who got approved LCs with PERM and apply for I140/485, will they have to wait for all of us (in BEC) to get through and then get processed? I don't think so. But their PD is later than us, will their I-140 applications get processed ahead of us, since we don't even have LCs yet? I am so confused. Please clarify for me. Thank you!
 
I have the same info as you case status RIR

Like the expert in this fourm mentioned ,

PBEC is now on 7/2001 RIR (reach region)... so only think you can do is file your 7 year H1 and wait to see if there is something in September !

If company does not want to help , I do not think you can do anything .

Now we start to see some approvals in both RIR and NON RIR, although not in big number, but still we can see they quite match your forecast. Thank you so much for your efforts and help to this forum, please do not get mad at or be scared away by some unfriendly posts here. Your help to this forum is incredible and please keep us posted of any updates.

Although I do not know where aprlc2002 gets all the information, I do not see any reason for him/her to misleading people, and we do see his/her forecase gradually turned to be true. No forecase can be perfect, guys/gals.

If we do not maintain our hope, why would not come to this forum. Everyone here is still hoping they will get their LC sooner or later. It is definitely OK to say some negative words sometimes because everyone will have some negative issues or feelings going on from time to time. But we just cannot live well always with such a negative attitude. Try to be postive looking at the world.

One of my teachers in my license exam preparation classes said something that I feel very enlightening: to get a license may mean more opportunity and money for you, but it is not worth doing to get such a license with a sacrifice of your health, your family, and your job --- you do not get your license, you may still live well, but without health, you cannot live well; you can lost a family and go get remarried, but the cost is too high; you can find another job, but the cost may also be too high.

Try to enjoy your life sometimes.

I'm waiting for 45 day letter.?

I sent an email to h1b7yr@phi.dflc.us to get labor proof for 8th yr H1B ext.

May be u can do the same to get temp case num

dont waste ur time, if you sent the application only in March'05 - people like me are waiting since '02
