PGY1 going PGY2 - J1 to H1?

Ayone knows if its possible for resident to go to other program in PGY2 with following situation?
.....
=> J1 visa with 2 years HRR
=> Gruaduating in June 08

I really liked other program who is offering H1B but not sure if I would need WAIVER since there are still 2 years left for program completion. In case I'd need WAIVER then on what one of 5 grounds that they have setup?

Changing the program or staying in the same program is the same. The only categories you can apply during residency are 1) Persecution 2) Exceptional hardship to a United States citizen (or legal permanent resident) spouse or child. If you are really fit in one of those it takes not less than one year to be granted.

you can change specialties once up to pgy2. you cannot switch to h1b during residency. you will need a waiver once you are done with residency.
