HI THERE
my mother is a permanent resident in the US , she apply for me I-130 but she want to leave the US forever , IF she lose her ( LPR) MY CASE WILL BE CANCELED OR NOT ???

other hand , in order to keep her (LPR) STILL VALID what she have to do ??? visit the US every year , every 6 month


any insight will be appreciated
 
if she loses her LPR status, your i-130 becomes void.

for her to maintain her LPR status she must LIVE PERMANENTLY in th USA. Visiting every year or 6 months for a little bit will not do anything.

Insight, let your mother be happy and live where she wants to live and you find another way of getting a Green Card. This way is not going to work, as you would probably have to wait several years for the I-130 priority date to become current unless you are a minor?

why visiting THE US for a little bit will not do anything. ??

if she have address and i have some one to keep me up to date with every correspond with the USCIS, dont think they would come everyday to her home to check her status in side or outside

Because she must LIVE PERMANENTLY in the USA, as a RESIDENT, someone who LIVES there.

Not a VISITOR.

Everytime she comes for "a visit" she will be questioned at the POE and asked for evidence that she is returning as a resident. And just having an "Address" is not going to cut it. She must LIVE, WORK, STUDY, etc in the USA for her to maintain her LPR Status.

This has been discussed many times, you can not be a resident of the USA while living in another country, so sorry to cloud over your plans but... it is not going to work. She will not be able to keep this up for the many years that it will take for your to get a Green Card through her.

Maintaining Permanent Residence
Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

* Move to another country intending to live there permanently.
* Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Fail to file income tax returns while living outside of the US for any period.
* Declare yourself a “nonimmigrant” on your tax returns.

Your mom intends to leave the USA for good, so her LPR will be abandoned. If she returns to the USA every X months for a visit, just so that one day you get a Green Card, then she is engaging in immigration fraud.
 
IF my brother ( US CITIZEN) apply for me how long it takes ???
